How can I determine if my engine is ULEV or not?

It's that easy unless some parts have been swapped. On another forum, I was helping out someone that at first seemed like it was not a ULEV engine. Turns out the previous owners raced the car at the track, and swapped out the engine parts, etc. In the end, it turned out the car was originally a ULEV, swapped with a F23A1 engine block (non-ULEV) with the ECU for the ULEV. That person had to use an air/fuel ratio sensor instead of a normal oxygen sensor due to the ULEV ECU.

Yeah, I operated under the assumption the car has not been modified.
