need some advise, what should i do??
ok so here is the deal. back in may or the first few days of june i sold a turbo kit to a member on this site(dont know his username). he drove to chicago to buy the kit. when we met i told him what i knew about the kit. we both agreed that the turbo had shaft play and would need to be rebuilt. he saw everything he was getting and gave me cash.
a few days ago(augest 23) he texted me saying that the inducer and the fins on the turbo are bad. he agrees that we agreed that it would need a rebuild but i didnt tell him the inducer is bad and the fins are bad. pretty much he says i sold him a product and i need to take responsibility for it. he said that he never ran the turbo on any car. he wants me to buy the kit back from him for $400.
i responded by saying that its been months since i sold the turbo kit and i dont know what you did with the turbo in that time period and i cant trust that you didnt run the turbo because i dont really know you. i told him what i knew, he saw what he was buying and he gave me cash for it. all i knew was that the turbo had shaft play. i didnt tear the whole thing apart so i was not aware about the other problems(this is assuming he didnt run the turbo in these few months).
we cant come to an agreement so what do you guys think should happen?

i am the buyer.... i also dont know the exact date of sell/buy... i bought the kit from him months ago knowing the turbo had a little shaft play and needed a rebuild, but he also said it came off his car working fine, he took it off cause he wanted more power... there was other problems with this kit when we met up that i was un aware of (i bought the kit anyway, spur of the moment i was excited, my fault) but this i s mainly about the turbo so anyways... when i bought it i told him i will not be installing it right away cause i still need a lot of other pieces to complete the kit. its litterally been sitting in my garage since the day i got it... the only thing i did to the kit was get a new wastegate spring for boost by gear... other then that it has been untouched.
Yesterday my buddy and i went to tear apart the turbo so we could rebuild it... he took off the hot and we see ALL the fins F*CKED... my buddy, being the turbo know it all, looks at it and says WOW the turbo is trash!!! i got upset and started texting UMAIR... we couldnt decide on anything which is now why its posted
in my eyes... its ANY sellers responsibility to know what they are selling and if the product is f*cked it should be their responsibility to make it right or take back the product... his defense was he didnt know if i ran it

i can have anyone i know tell you its been sitting there in my garage since i got it... the Manifold does not work with AC so a half radiator is needed, my car still has the OEM full size integra radiator, i just got my Half size one last week and its still in the box unused... the Piping will NOT work with a GSR intake manifold.... my car STILL has the OEM GSR intake manifold... i have a BLOX one but its still sitting in my garage... you can tell when parts have been recently taken off or put on... i invite ANYONE to come check out my car and all the turbo parts

It doesn't seem like the seller is at fault. These are used parts so it is an "as is" sale. If the seller knew the turbo was ****ed then I would at least want a lil compensation but it doesn't seem that way.
Sucks but sometimes used parts turn out to be junk when even the seller didn't know.
If it needed a rebuild anyway you could have asked to open it up and check out the internals..

There is no warranty unless agreed upon. I've always been under the impression that everything on this board is sold "as is."

i'm with the SELLER on this. you saw it and you guys agreed the turbo needs a rebuild before you gave him the cash.

i honestly had no intentions to screw him over and if i did i would have ignored his calls. i have old tons of parts/cars on here before and im sure someone can vouch that im not that kind of seller. im really sorry that it happened to you integradc4_rg87.

Unmair seems like a cool guy though I've never purchased fromhim before. In this case it's the buyers responsibility but maybe you guys can agree on a small settlement however I don't feel this is necessary.
I'm confused the hot side fins were toast? You can see those unless the dp was still bolted up. Unless it's an internal failure which prevents use in this case I side withthe seller.

This kind of situation sucks but the long and short of it is that you bought used parts for cash with no warranty. Even if the seller was trying to screw you and sell you a turbo that he knew was bad (not saying he was) its your responsibility to make sure everything is in order before you buy it. You should have set up some sort of agreement when you bought it saying that if you found the turbo to be bad when rebuilding it then you would be able to return it, or something along those lines. Sorry dude.
thanks for all the replies guys...i feel bad for the buyer because i know exactly how he feels. we are working on a small settlement and only cause i feel bad for the buyer, not because i was at fault with the sale.

The fact that the seller didn't physically rape you and then steal your car and shoes (what Chicago is known for) is reason enough to say thank you Mr. Umair, and move on with ideas to fix the situation on your own (eg rebuild or resell)
On a more serious note, it's easy to say that the responsibility to fully inspect the item rests with the buyer. I've always been set on full disclosure myself, but if it's something you just don't know about, like the turbo situation in this case, the responsibility defaults back to the buyer to make sure everything is good. It would, however, be generous of the seller to possibly come to an agreeable buyback price if he's certain that no fraud has taken place.
