Yup, it's sad to say but my caR was involved in a collision this past tuesday at 5:20pm PST. The damage is not severe, but I am definitely not happy.
The concentrate of the impact is centralized around my driver fender/hub/spindle area (parts anyone?). The front bumper was tagged and so was the driver headlight (both will be replaced with OEM new; what's good?). The lip was scratched pretty badly from the tow truck (had to be towed) and was semi twisted because of the hook that was centralized under it (NOT A PRETTY SIGHT!) Might I add the door is creased from being opened with a ****ed up fender and not to mention there's a 1" blue Nissan Maxima racing stripe going from my door to my rear bumper (just barely tagging it- twice it seems). Did I forget to mention that this lady that hit me (Star) indicated she did so on purpose? She apparently wanted to total her car...
Mercury insurance has claimed 100% fault for the accident, on her behalf.
I'm highly concerned what kind of damage this has done to the resale value of my R and what I should expect/push for LEGALLY, when it comes to this issue.. Anyone with good advice (besides get a lawyer- which I'm probably going to have to do)..
I Have/HAD intentions on repairing this myself but from just a phone interview with the person who wrote the sheet I'm sure SEVERAL things have been missed and getting a supplement requires the car to be repaired by a licensed repair facility (which I DO NOT OWN). However my dad is a teacher at Cerritos College and he teaches autobody collision and repair and has access to all the frame machines, etc so getting it fixed PROPERLY is not an issue when it comes to "Do-it-myself". What would U recommend?
What should I do at this point? I'm waiting on the sheet to come in before I know ultimately what I have to do, I just want to see if anyone on here has had a previous experience or know of the outcome of such experiences

get a personal injury attorney. they work on what they make you. all damage will be paid for and you will receive injury money. as far as resale goes, it shows up on carfax but a decent shop will repair it to the point that it's impossible to tell. the couple grand you get in injury money is also a nice buffer if you're concerned about resale. unless you have a sub 50k mile car that's mint the hit should be minimal. it's all about what the buyer will pay anyhoo.
get representation in court, you can prolly get anough money for a jdm front end and a k swap lol , not saying that you want to do that ...but you will get a good chunk of change ..post pics!!!
Fight for compensation for your injuries, and emotional damages...have your lawyer be very persuasive about your infatuation with your car; as if the car is your child, or the only memory you have left of a deceased relative. Also, (which should be fairly obvious to the court) your lawyer should show how careless the lady was, and thoroughly state the intentions that she addressed to you after the accident (how she did it on PURPOSE). If she truley did this on purpose, take her for everything that you can)...imagine if you lost your life in this accident?...imagine if your car was completely totaled in this accident...either/or could have happened, but fortunately didn't...so, when this goes to court, let her have it (legally).

As far as the insurance check goes, you can say you are undecided where to take it. They will send out one of there own adjusters, and then write you a check. They will lowball the **** out of you normally so you need to get local body shops to estimate it as well. You can argue this with the insurance and get more money if the numbers are off. Good luck, what a dumb woman to purposly involve someone else in an accident.

I would say throw any decency you have right out the window. If she stated she did it on purpose, I would take her to the cleaners....make her wish she chose to hit a Ferrari instead.
In my situation, If the same lady wrecked into me, no matter what kind of car i was in and told me it was on purpose or even insinuated that it was...well let's just say i'd make Chris Brown look like a saint.

NVM the cash you can see at the end of all this after you get paid for the car and the medical bills. If I were you I'd go to the doctor and the hospital everyday just to build the case and get more out of it. She hit you on purpose?!? Nail her every way you can. I'm not a lawyer but I think your lower back is killing you.

no **** man. this is really a valid point though because if this was some random case of road rage like what happened a couple of days ago here in tx, person a tried running person b off the road and was charged with negligent homicide or attempted. IMO there is no difference between that case and this one. both were purposedly done.i say milk it for all you can. most of us never get the shot to rape an insurance company the way they reem us on a monthly basis

being your car is already ten years old and its black the chances of your paint being faded are really high so also tell them you will need the entire car sprayed over again because the newly painted parts will stand out from the original ones. dupont chromabase is really good btw. that should easily add an extra1500 - 2000 to the estimate. we just did something similar like this for a customer not too long ago at the shop i work at
Normally I'd scold the **** out of you for such a dumbass comment, and blather on about how THIS is exactly the problem with the American legal system. However, the whole thing with her purposefully running into him does sort of throw the legal book out the window. I don't know that your approach is the correct one, but there should be proper compensation paid to the OP, beyond just repairing the damage (as the OP mentioned, this will have an effect on the car's resale value).

Sorry to hear...glad you have the resources to fix heR up.
This would definitely be the best route. The difficult part would be holding back the initial rage that would make you do something that would equate into an instant trip to jail.
if any of you guys ever beat the hell out of someone in a similar situation remember the following
1. don't use any weapon
2. don't break bones
3. don't cause any permanent injury
doing this will keep you doing a few days / weeks in jail, breaking those rules can equal years in prison.

If you want post pics of the damage and what the ins company wrote up and I can take a look at it and tell you if its fair and about how much its off.
