Was it a small dealership? Judging by the auction, I'm guessing it is. There's probably nothing you can do about it because it's up to the buyer to research the car before purchasing it. Also, very minor damage(ie. small tap, small scratch with another car) can be considered accidents if it was reported.

well surely if the dealer has taken it in a p/x they would of done the check before hand for there own satisfaction?, also, is it not illegal for them to sell a vehicle knowning that it has been in a heavy accident previously and not passing this info onto the customer? (it is here in he UK)

did you aks the dealer for a carfax report before buying it? a lot of dealerships offer a carfax report for free. maybe you could do something if they gave you a fake one or a edited one.

That would be called 'fraud' my friend.

Why didn't you get a carfax before you bought it?

Generally people run a carfax (((((((((((((((( PRIOR )))))))))))))))) to purchasing the car. Why would you take someones word especially a shitty car salesman. Take that bucket back. Why did you pay so much for a 98 civic in the first place, that was your first mistake!

Here in Canada if you buy a used car the SELLER must provide you with the inspection report (carfax etc.) and you must submit it when plating the car @ the DMV or they will not let you plate it.

Also, FYI if you call honda they also keep these types of records but they tend to be inacurrate. According the Honda Canada my EM1 was destroyed. But according the provincial registry it was only accidented. When I took it apart to inspect it it was just the bumper and one fender that had been replaced. (I was given the car for a full day 8am to 8pm to test drive and inspect it)

Good luck man.

Did you buy the car "As-is?" You know, you should have gotten a report before purchasing the car. Truth be told, if you failed to ask them for a report and signed a contract to buy the car you're SOL. There's nothing you can do to get away from it, even if you tried to take them to court they have a contract against you. I suppose you could go there and try to say you'll trash their rep by telling everyone not to buy from them, but I don't know if that will do anything. But if you bought the car as-is there is nothing you can do in legal terms.

Why anyone would buy a used car without getting a report (especially because any dealership will give you one for FREE) is beyond me. Also, why in the hell did you buy a 98 civic for almost $8,000? Holy **** man! You can get a 2008 for like $16k.

My brother had something similar happen. He bought a lexus is300 and the dealer gave him a carfax report saying it never had been in an accident. About 4 years later he went to a dealer to see about trading it in to get a new car and the dealer pulled up the carfax and saw it had been in an accident. He had all the paper from buying the car except the carfax. It's to bad could have goten them for fraud.

"tell them your going to report them and they going to get their dealership license taken away from them if they dont take the car back and give you your money back, take the report with you tho."
I agree talk to the manager/owner and threaten to report them. gl

The problem with this is that it's not like the dealership gave him a false carfax. They didn't give him one at all because he didn't ask..that's on the buyer. Yes, dealerships can not deny the request for a carfax, but if you don't ask it's not their problem. If he bought the car as-is and signed the contract he's pretty much screwed. Not to get you down, OP, I just don't want to give you false hope.

I agree with you. The thing though is that the dealer told him it had not been in an accident, which is not evidence to sue but is enough to file a complant if they don't make things right. The dealers not going to want to be reported. It might be enough to have them try and work with you. It doesn't hurt to try.

You got screwed. The damage had to be significant if it was reported to the DMV. Alot of these fly by night shops will sell you a lemon and fight it until the end because of the "no cooling off period". I don't even think it will qualify under the lemon law because it works and isn't totaled. Paying that much for a used civic with over 100k on it was your first mistake. Secondly, buying from a shady *** corner lot dealership was your second mistake. Lastly, not getting a carfax before buying it and at least not doing a thorough ispection of it yourself was just not smart. If it was sold as is then you won't get anywhere with trying to return it. Your last resort would be to get a lawyer and then you'll be out more money for the fees. Probably gonna have to chalk it up to a loss and learn your lesson. Impulsive buying is always bad. Patience and going through the proper steps to assure yourself you're not getting screwed is the only way to do things with all these liars and crooks nowadays. The sad thing about it is they probably got it from the auction for a grand or two, spit shined it, and ripped you off.

oh yea i wouldnt doubt it, and the problem is now, if i try to sell it in a few months where i owe less, noobdy is going to want to buy it becase of the prior accident

basically heres where it all started okay, i went to trade it in for a subaru and i told them that i owed 5700 on it and they looked at me and said quote "damn man who screwed you" then i said oh well i just dont want it anymore can you take it as a trade in, and they said sure they will have it inspected to see what its worth..

so as im waiting for the loan paperwork to go through they came back within 20 minutes and said that they wont give me any more then 1500 for it, and i was shocked and said why not its still in great shape, and their mechanic said that the whole rear end has been replaced and some of the front end, so i just lost it and told them **** ill be back in a few months **** i was soo mad, holy **** i have never been so upset in my life

This is the big one right here, you can get a 1 month unlimited carfax subscription for something like $25. Why someone wouldn't spend an extra $25 above and beyond the purchase of a car is beyond me. When dad was looking for a tacoma a couple of years ago we carfaxed at least half a dozen of them, the only thing is sometimes things don't always get reported. The tacoma we ended up buying had some front end damage that was poorly fixed, didn't really affect the structural integrity of the vehicle or anything, but the front bumper didn't fit quite right, it was a private sale though, and the guy we bought it from did tell use it had hit a deer.

Bottom line:
-Carfax before you buy
-Try to borrow the car for a day or 2 before you buy to tear it apart and see if theres any hidden damage, or worn out broken parts before you buy, when you go back to purchase use this to negotiate a better deal.
-I know this doesn't apply in your case, but always check to see that the check engine light comes on when you turn the key to accessory, some people pull the bulb to hid a CEL.

So, you paid too much for a used car two months ago. You still owe more than the car is worth and you're trying to trade it in on a subaru? It doesn't seem like you're really thinking these decisions through very well.
