01-0834... STOLEN FROM THE BODY SHOP!
I had just recovered my R from theft and luckily it was intact... However, while at the body shop being repaired, it was stolen again. I'm unsure of how to handle this at the moment. What rights do I have and how will insurance handle this? If anyone had similar experiences, your input would be highly appreciated. Thank you...
Does the shop have insurance? Find out their policy first. If they do, do NOT go through your insurance but go through theirs.
The shop SHOULD have Insurance. If they opperate without, contact the BBB.

What I'm actually worried about at the moment is the fact that since my car was just theft recovered, the value of the car probably depreciated significantly. I'm worried their insurance won't pay me enough to afford another one, especially with less than 60,000 miles. I will talk to the body shop once I have my police interview...

Call a lawyer (or bluff them saying you called one) Get them to think your going to go after them for more, or tell them it's worth more.

I'd definately threaten a lawyer...I had to do this with some very large companies in the past....even ones very well known on HT....their whole attitude changes very quick....

I also feel that the body shop was in on this... the car wasn't drivable when it was stolen the second time around. The dash and ignition was torn apart and from what the police officer just told me, it looks as if the car was either pushed into the streets and towed away or the tow truck actually came into the body shop and pulled it out. I will go to the body shop later today and see what will happen. They are going to replace everything whether they like it or not...

I would use that as an angle for the body shop... Tell them it's awefully suspicious that the car was NOT drivable yet still stolen from there. Make them think you think it's them or they are involved and your lawyer was busy today but you have an appt. with him/her tomorrow.

the shop should take care of it, i had a similar experience at my body shop, i had 00-667 in for repair after a run in with a curb, i told them to keep it inside at nite and they didnt listen to me, one night someone went to the shop and stole my front bumper w/ the lip and my license plate, they paid for new parts & kept it inside until they had completed the repair, its tough to own an R. hope your situation turns out positive.

When I first opened this thread and began reading, I thought 'SWEET, it's recovered'!... My heartrate just shot up! My guess is someone at the shop knows where it is. I'm sorry to hear about this. Best of luck to you!

Quick not on the lawyer bit, that doesn't always work. Some companies will immediately stop talking to you when you threaten a lawyer except to give you their legal firm's information. If they call that bluff you'll be more screwed than you already are...

Just thought that I'd give you guys an update on what is going on...
I went to the shop and talked to the person in charge and he informed me that body shops and insurance companies have some sort of agreement in which if a car is in their shop getting worked on under an insurance claim, as long as the shop did their part in securing the car on their property, they will not be held fully responsible.
He told me that MY insurance company has been informed and that they will take care of everything. I did not threaten him with any legal actions because I wanted to talk to a lawyer before making such a rash decision. Hopefully one way or another, things work out in the end. The body shop did inform me that they will help pay for my deductibles... but we'll see what happens.
