Default My bike got impounded and I wet to jail last night......

Last night was a complete disiaster. At about 5pm I got a call from a friend inviting me over for dinner. Well I hopped on the bike and went for a cruise over to his house. I spent a little time over there with him and I gave my godson a few rides on the dirtbike around the yard. The typical Friday night......so far anyways.

Well it got to be around 9:30 and everybody was geting tired and ready to hit the sack, so I decide it is time to go home and do the same. Well I start back on my regular trip back to the house. I live about 30 minutes from Mike's so it is not a bad ride. I have some interstate to travel on on the way home.

Well as I am cruising home, just putting along in the slow lane, some jackass runs me off of the road. I am going down the interstate mind you. I somehow keep from dumping the bike and come to a stop safely. Well the driver of the truck realizes what had happened and stopped. The first thing the jackass did was come at me yelling telling me that I was in the wrong and then it was on. I did nothing wrong to the guy and I had to evasively avoid him crushing me with his giant 4x4 truck. I point out what he did and he gets all defensive. By this time someone else pulled ff ot the side and called the police. Well as he and I were battling it out verbally, he decided to make it physical. I ended up finishing the physical with a few well placed blows. The big redneck fell like a sack of potatoes. AS SOON as the lump hit the ground I hear "GET ON THE GROUND!!". I immediately knew what was happening, I was going to get in trouble. The police were already there.

Both of us got arrested and both of us had out vehicles impounded. I had a witness on my side saying that I did not instigate the fight and I was just defending myself. They also whitnessed that the man had run me off of the road. Unfortunately in NC both parties get charged. We both had to spend the night in jail and await arraignment this morning at 6am. I got let ot on personal recognisance bond and the other guy had priors and his bond was at $2,000.

I now have to wait until Monday before I can get my bike back, pay the tow/impound fee and I have to go to court on the 17th. I had a really shitty night.

The officer told me that all in all this will probably cost me upwards of $1k if it is not dropped.

Damn sorry to hear that dude. Time to find a new state to live in. In VA if someone starts an altercation or even threatens you and takes moves to carry out that threat, you are allowed to defend yourself with force commensurate with the threat.

Look on the bright side though. At least you dropped him and not the other way around.

Sorry to hear that... the law definitely is not on your side there, but at the very least you've got a witness and managed to land a few blows

I hope everything gets dropped at arraignment-for you at least

Have you thought about making it a civil matter after this is all over? I'd definitely be heated over far less than a grand =\

edit: is this why you were speculating about selling the bike?

Either way you look at it, this is still going to cost me money. The cop was telling me that I coupld possibly loose my license over this too, due to the fact that it happened on a public highway. Complete BS!

I did nothing but save myself from eating dirt and getting assaulted. What else was I supposed to do? This hole ordeal makes me very upset and confused. I am getting punished for defending myself? I HATE NC!! I really want to move back home to Charleston, SC where if something like this were to happen they would just let me go home and give me a court date to appear at. No jail overnighter, no fines, no impound fees, no money spent on a taxi ride home........[freak]ing taxation without representation!!!

Bullshit like this is why people hate the justice system. The good get punished and the bad get set free.

yes, I am going through a career change at the moment and I do not have the money to spend I am living off of money saved up and awaiting training to finish before money starts coming back in.

you'll be ok dude. make sure you get that witness' statement and/or info in hand asap, and the charges are going to be dropped. no sane jurist in this country would even attempt to prosecute you on this.

This sounds like a totally F'd situation. And not to sound like a woo-woo hippy but i'd try and keep a positive attitude about it. It seems you've got facts and logic on your side and hopefully there's enough reasonable people in the right places that this will get sorted out.

If it were me, and that guy came at me I would drawn on him.

Why does this post not surprise me at all.

If someone ran me off the road, and I saved it...I'd hold off for a second or two because I know I'd be shaken up...Once I saw him pull over, I'd throw the bike in gear and GTFO of there...you NEVER know what someone is going to do, or if they mean physical harm like this...Worse off...You wouldn't be sitting here making this post if he had a gun.


Next time, THINK AHEAD..and realize the consequences before you take action.

^^ i agree.. you never know if some crazy peeps out there doing stupid shitt that might get you killed. he may have friends etc... just be careful out there...


best thing to do is get his lic plate and take care of it later...

Same kind of thing happened to me when I was going to my car form a bar and found some guy laying under my car. Beat the **** out of him he picked up a wrench I pulled my knife(he was lucky I didn't have my CCW yet or else a HK .45 would have been pointed at his sorry ***) right as I brought eh knife out the cop came. Night in jail but no biggie since the other guy was a moron I was only detained till 3am spent most of the time talkin with the cop at jail pretty cool guy real into cars.

I think hes trying to say, its easy to sit there and tell everyone what you would have done but unless you were actually in the situation, then it doesn't matter.
