I am picking up my 2007 s2k today, few questions...

My wife and I just put a deposit on a Black 2007 s2000 w/ 12k miles. We are buying it from a local Honda dealership, and it is certified. (4 yr/48000 BB & 7 yr/ 100,000 PT) For what its worth we are paying 26,500 with the certification.
The 1 issue with the car is 1 of the tires is a Toyo (Driver side rear). Supposedly the owner had a blow out on the way to the dealership to trade it in, so I have 3 OEM tires and the 1 he used to replace the blowout to drive it to the dealership.
Honda is however only going to replace the 1 tire back to OEM, however, my concern is having 1 tire brand new, and the others have (unknown miles - not sure if they were ever replaced once yet or not). I brought this concern to their attention, and they refused to give me 2 brand new rear tires. They say it's safe to do this, and the other tires do not have enough wear on them to make a difference. I however, disagree.
We are scheduled to pick up the vehicle tonight.
Any pointers / advice?

Don't leave the dealership till you get two brand new rear tires. (the fronts don't matter as long as they match each other). The fronts will usually last you through two sets of rear tires.
The car has 12k miles on it, the tires are supposedly OEM; therefore, one can only assume that the rear OEM tire also has 12k miles on it.

mine were from 2001, along with my brakes. theyre still on there too

all the same! the looked new to haha so i didnt look until a month latter. it had 36Kmiles on it so im thinking none of it was really hard driving

Is their anything in the owners manual that I could show them to prove this? If so, can I get a page reference. Appreciate all the help I can get. I really don't want to leave there with only 1 new rear tire.

Don't know if it's in the manual or not, but the rule of thumb, is if you replace one rear, you replace the other (regardless of condition).

laguna is very nice...my color preference was white>black>laguna

Well the only way I think I'm going to be able to get this car with 2 new tires is to pull it's a "Not safe to drive" like this card and be able to prove it. Then they'll HAVE to do it.
Tell them that ... The problem with replacing a single tire is that the vehicle will tend to pivot around the odd tire. Also due to one being used and has lower tread, regardless of how little it is, will throw off the balance of the car (which it will). Not to mention possibly be hurtful to the rear differential.
I would think that it could mess with the stability control and ABS too since the two rear tires are not necessarily the same diameter and the wheel speed sensors will be seeing different RPMs.
I would settle for nothing less than two new rear tires unless they can prove to you that the other rear is practically new.

Supposedly they took the trade in for the owner's friend son, so they gave him a good trade in value, which means, I pay for it apparently.
I just got off the phone with Honda, and they say they are the original tires that came with the car brand new.
They said they will measure the difference between the new tire and the old, and if it's 1-2 MIL difference, they aren't changing it, however if it's 3 or more they will.

. If they said they are the original tires that came with the car, that right there says the tires have been on the car for 12k miles. That's a big difference than the tire you're getting with 0 miles on it.

regardless of what the dealership has told you, i doubt they would happily drop a 26k sale for the cost of a 1-200 dollar tire. if you go in there willing to back out of the purchase, i would put money on the fact that the dealership will cave.
Tell them you are willing to travel around and visit other cars for sale and will wait until you find a dealership that wants your business. ur giving them 26.5 thousand dollars worth of business...

if they are gonna be this big of dicks about 2 tires. walk. end of story. not worth dealing with a place like this.
imagine the issues you are gonna hav if you need any wwarranty work done.
go to another dealer, tell em aobut this car and how you want it and what happined. ask if they can get it from them, give you the same deal and buy from them. DONT BUY FROM THIS DEALER. THEY SOUND LIKE SCUMBAGS
