I get this problem on my Civic, too. If my car is on a driveway, or anything with an angle, it won't shut. It gets insanely annoying...

Did this just start or always been like this? Has the car ever been hit?

make sure the handle is all the way down, mines just bounces back up when the latch handle is slightly up.

Can you close the latch when the hatch is open, to make sure the latch is not the problem. If so its got to be out of alignment. Whether its the latch, or the hatch. Make sure the cable is not keeping the latch open.

I agree. Mine is the same way too. The hatch wouldnt close after a huge branch fell and broke the original one, so i had a spare one and replaced it within an hour but didnt take the time to really align it because it started storming as soon as i got done...so it wont latch with the hatch down...thats the problem...now for the solution, i would have to get in the car and use a flat head screwdriver and twist the hook on the hatch while someone else pushes down on the hatch itself...it worked...so i AVOID opening my hatch...oh and i'm just lazy to align it i guess.
