Default scammed on a B18 swap: where to go from here?

So i got stupid and handed this guy $1000 for a swap. The idea was that he was going to keep the stuff at his place, and i was going to roll my car in and have him do the work in exchange for my EX engine, or $500. Seemed kind of cheap, but okay.

Two months go by, and the engine just sits there in his garage and i get plenty of excuses... then i leave my car with him for two weeks.. he hot wires a phone charger to my radio, detatches my center console, eats a cheeseburger, and smokes a cig in the backseat.

I get tired of waiting and pick up my car. Then i pick up the engine. He says that the other parts are at a friend's house cuz he can't work on his garage, and that he'll drop them off with me tonight.. but doesn't return phone calls.

I take the engine home. it's a '94 B18B1. I paid for a 2000 B18B1. Engine looks like a 1994 too.. rust in certain locations.. corrosion on the block.. etc.

I have a piece of paper stating that he sold me a 2000 integra swap with his signature on it.
This dude is not trustworthy or together.. i know i will not get my money back.

Where do i go from here..? do i sue? leave flaming poo on his lawn?
I know his grandma, girlfriend, address, and a few of his friends.

What year is your car? check the vin of the motor and you can determine the year. Doesn't look like you're gonna get any money back. but 1000 bucks is the average price for a ls swap.

It is a 94.. which is obd1.. in california, it is not legal to swap in a motor younger than your car, much less into an obd2 car.

It is an OBD1 motor, and i am told that they did not stamp VINs on them until '96.
I cleaned the grime off the engine, and did not see a VIN, nor an area where it looks like it was sanded off the block.

and throwdown.... pull the attorney card? i mean.. could i actually sue for this.. in small claims court? i won't make threats unless i know what i'm talking about so please help me out here

Frankly i feel very lucky to have my car back for one.. and at least something.. but i am still super pissed.

Thats not going to do anything, if his working out of his home he wont even be claimed as a mechanic, just someone that did a favor for someone. Your just about SOL in this situation. Only thing i see you really being able to do is give him a bad name if he trys to make something for himself. Another thing that you could try is small claims. We did take someone to small claims and won, so it is possible. It really depends on the person if youll get your money or not. If there is nothing writen out that he sold you the motor he could just say he never sold it.

Also there is no engraved VIN numbers, the VINs look like this:

I would think this is a good enough reason to take him to court. I mean if you do have a paper that states that he sold u a 2000 integra engine, (was he specific about the engine and/or model of the car?) and he signed it then u got a good reason to try at least.

my dad is a weed smoking janitor. i don't think he could pull the whole suit thing off. thanks though.. haha

i suppose that looking into small claims court is the best idea.
I will dig up the piece of paper i got from him tonight.
No word back from him re: getting the transmission, ecu, other parts etc.

how in the HELL do you get ripped off on a motor in person?

i could see if this was something on ebay or whatever, but HOW do you hand over 1000 bucks without seeing a motor?

you can take him to small claims court, but unless california is different than most states he'll be fined blahblahblah, and if you're lucky you'll see 20 bucks.

i don't get it...are you scared of this guy or something?

I agree, I don't see how you got scammed when you met with him in person.

Anyways, you can't do anything about it, your boned for sure. At least you got your car and an engine. Take is as a lesson learned and don't do anything that silly again.

eh.. i am not scared of the dude, just cautious. He does have a lot of large friends, who live in the country and enjoy drinking a lot.. so i am not gathering my homeboys just yet - i'd like to work this out as civilized as possible. I stopped by his house and talked to his neighbors.. i've got some information on him now. Enough to do small claims court if i need to.
I would love to see this ***** in a suit and tie.

I saw the motor in person before handing over the money. It's definetely a B18B1.

I talked to the dude on the phone.. he claims that this genuinely came out of an integra.. out of a friend's car. And that if he can match up the serial numbers or whatever, his friend will give me my money back. This is pending a visit to the DMV.

Is it possible that this is a JDM motor? i hear that JDM obd-II motors do not have VINs on them.
Also.. can you pick out an obd2/1 motor visually? ( ie: holes for extra smog equipment? )

I could use some more facts when he calls back 'after his friend visits the dmv on wensday'.

^^from how unreliable this guy seems, I wouldn't even trust the motor. If the motor is stolen and then installed in your car the cops DON"T CARE if you bought it legit. wait to see if he calls back wed.

sorry man, a lot of for you.

88-93 ls blocks will be b18a,94 and up blocks will be b18b.I think they went to obd2 in 1996.The 94 blocks dont have vins on them.I dont know if this will work, but this is what i was going to do with my daily. Use my 94 block but put a 98 obd2 head and ecu, and try to get it ref'd.The guy seems kind of shady, so im not sure I would even want to put the motor in my car.If you can find out if its legit or not, do a compression check and see if the block is in good condition. It might not be all bad.

corosion on the block?????? you claim that as a problem.......all blocks are corroded. i have an 06 accord with the aluminum corroding.

you're screwed. can't report him as a mechanic.

you also paid too much for a 94 LS.........you paid $1000???? its really only worth around 400-600 especiall in socal!!!!!!!

where to go from here:

1: take your ex motor back and your money back, install it yourself (what you should have done in the first place to avoid situations like this)

2: do you want this LS motor? on a bill of sale you want his drivers license number and adress too. then deal with him.............tell him to keep the $1000, you get your car, and motor back you install it yourself.........
