TITLEWORK NEED HELP

Well i traded cars with this guy and he had lost the title. He went to the dmv and got the title application for a new one. Well he gave me the application and said that since my info was on the back that i could go get a new title, but in my name. Ok, i didn't think about it really. I never did this before and i didn't know.The dmv wont let me do it, and now his phone is cut off. Is there any way i could file for a lost title and get it back in my name? or any legal action i could take against this guy if i need to? Any help is appreciated..thanks

oh this guy lives in nc and i live in sc if that helps.
