Need some legal advice, related to my R

Well I bought it april 13th of 2007. When I got in the car I noticed that the 2nd gear would not go in right, then it started poping out. It was never mentioned in the add when I purchased the car. The seller sold me the car knowing the tranny was ****, and then said that he would pay to get it fixed. I being a mechanic, pulled the tranny, had an acura tech rebuild it for me and I put it back in the car. I felt that I did the kid a favor by not charging him labor other than what it cost for the Acura tech charged me to do it on the side, and I got the all the tranny parts at cost. Now the kid wont answer his phone, or any of the messages that I've left him. Other than Murder his family what can I legally do, Small Claims court, Ive still got all the old parts.

Wow, that's pretty shady of him, I'm not sure, I've never been in a situation like that. Do you know where he lives or works or anything? You could go confront him in person

well the thing that really ****'s me off is that I saw him just about 2 weeks ago pulling out of a Subaru dealer, and I got him to pull over. he said he would get me some money this week....yea, nothing. I know that hes in the Air Force, but hes back now, so i want the 1000 that he owes me. If I was to take it to a dealer, have them pull and rebuild the tranny it would have cost him a sht load of money. I tried to help him and I got fooked
Im afraid you would have to PROVE this arrangement in order to get a legal ruling in your favor. I do not see anything in the FS ad saying the tranny was bad and that he would pay for it to be repaired. Unless you have some saved PMs or something, I think you are SOL.

2nd gear, 1-2 sycro sleeve set, 3rd gear, 3-4 sycro sleeve set, few bearings, seals and fluids, slave came out to about 1000 thats including the rebuild

Did you test drive? Did it act up during the test drive?
Dunno on the legal, but my sense is it's Buyer Beware.
Seems like you'd have to prove his knowledge of the issue. Which means you need evidence (credible witnesses, written notes, etc).

I'd be on your side, but who's to say that you didn't do it and your trying to charge him for it, that's how the court would look at it because you don't have proof that it was like that when you bought it, which just makes the seller a piece of scum

very true, the tranny was def junk when i got it, also the Tbelt was never done at 119k when i got, luckily I know how to work on cars other wise i would have been totaly SOL

I agree. Its going to be a "he said, she said" type deal in court without anything in writing. He could as easily say that he never said anything to you and say it was "buyer beware" Good luck on it but I dont think anything will happen if you go to court. I would just try to get it out of him yourself

Agreed! I work at a Honda dealer. Synco sets my price only cost about $120 each. x 2 is $240. All the case bearings minus the differential bearings add up to $90. 3 quarts of MTF is $12. And a tube of Honda Bond is free supply. I don't think your friend really hooked you up, especially since you pulled the transmission out yourself to begin with. It's been said already, caveat emptor. If the seller didn't misrepresent the condition of the tranny, you're out of luck. Tranny components are wear items, especially on itr's that are tracked and have relatively high miles. I'm sorry to hear the seller wasn't straight with you.
