Can a cop make you open your hood?
I was wondering if in CA. can a cop make you open your hood for him to inspect. I know i've hered that they are not supposed to be able to look in your trunk or gloove box with out consent. I have a 95 civic with a B20 swap which is illegal bc its a truck motor, so I want to know if legally i can deny him to search?
they can do whatever they want if they have probable cause. and u live in cali which has a big problem with street racing and it also has the most strict emmision laws. so im sure he could pop your hood if he thinks that u have something thats not street legal.
Driving is a privilege offered to you by the state. You're likely being pulled over on public roads. Your tag is issued to you by the state. The specifications and safety requirements for your car are made by the state.
Why does it not make sense that they can pop it open no questions asked?
When you sign that affidavit when you get your permit it says something about you being subject to blood alcohol tests, inspection, etc.
You HAVE to take a blood alcohol test whether it be a breathalyser or a blood sample.
You HAVE to pop your hood because you drive on public roads.

my marriage license is issued by the state too, do they tell me and my wife what to do? if the cop is asking consent, or has some type of warrant, then it's a different story. but if he's just reaching in and popping the hood then that's a different case.

yea i dont think the cop can just reach into your car and pop the hood with out some kind of consent from you. but i know for a fact if they ask you to pop the
hood and you say no they call another officer over and a tow truck. if they have reason to believe that u have any stolen parts or you are not complying to the emission laws they can do whatever they want. i have a family member who works for the police and im almost 100% sure that they can do that. same reason as to why they can search your trunk or your car for that matter, if they can do that then what makes the engine compartment so special?

I understand, no he can't just reach in. He does need probable cause. A warrant is not necessary. Probable cause can be anything.

So what is considered probable cause? I know if you get caught street racing they could, but what if your just speeding?

really why why are you so bitter that means if it happens to you a cop pulls u over to search your vehicle without probable coz that means u will right
eH.
always ask if you have to consent to a search. if the cop gets angry
with you it constitutes police brutality and is a civil rights violation.
