its like a small metal doughnut with a pivoting piece inside

The boot holds in oil to keep the joint lubricated. If it's been like that a long time, its prolly pretty fucked. Has it been making clunking or grinding noises?

You risk your joint seizing and snapping the axel off. How much time before that will happen, will be determined by your environment such as dust, dirt, roads, etc.

If you can inspect it and know for SURE that it's not messed up or severely dirty inside, you could get away with adding more grease and a new boot/clamp. Good chance you're gonna just trap in sand/dirt in there and eventually it will still lock up. Most will just recommend that you replace the axle. You just never know.
