Shift linkage problem, shifter bolt not lined up? wtf?

I bought this EM1 linkage from someone here on h-t, and I noticed the bolt that runs through the shifter does not line up.. the holes are not horizontal from each other. what the hell is up with this?

it was probably just bent out of place...bend it back!

is was bent up, but i straightened it out and the holes DO NOT LINE UP, here's another pic

look at the distance between the hole and the rod on each side.. clearly the side with the bolt in it is longer than the opposite side

looks like the side with the bolt in it is bent towards the bottom.

easy way to tell is to stick the shifter in there and seeing how much of a gap is left.
