got into an accident
Hey honda-techers I got into a car accident today and well... here's the diagram i made real quick in illustrator.

I know the right turn has the right of way but from what I remember before making my left, I waited a good 3 seconds to make sure it was clear for me to make my left turn because as you can see the cars lined up to make a left blocked my view. Right when I'm about to clear the intersection this explorer just looms to my right and I'm like wtf?! and its left rear corner totally just swipes the front right corner of my civic. Now I'm asking your opinion. I know I'm at fault BUT you can't deny that she didn't make a turn into her respective lane and came into mines probably going to turn left into Del Mar.
Sigh insurance...
AND last fall an old lady rear-ended me. Totally her fault. Just my luck eh?

Dude that sucks, hey if you can prove that she came out of her lane than I would try and fight it. Based on your diagram she had the right of way for the right hand lane. However if she came out of her lane and into yours it kinda seems like it would be deemed her fault. But I dunnoh, just the way it looks to me.
I don't believe the accident is your fault; at the very least, it's certainly not 100% your fault. Depending on the damage and your (and her) insurance situations, you should consider contacting an attorney. There are attorneys who specialize in this sort of thing, and you can contact your state bar association for a referral. Shame you're not in SC or I could help you.

good luck. in my opinion, its not your fault. these accidents are just one of those things where your in a bad place in the wrong time. but yea. i need to find an attorney. kind of giving up on my accident. arbitration is stupid. deal with it asap man.

I dont exactly know what kind of intersection this is, but are there green arrows (not just a green light)? If there are green arrows that told you are in the clear to turn than it would be most definitely her fault. If not, they will treat it as it being no different than if you crossed into her lane and hit her. Whoever is further behind is their fault. But, lawyers can do wonders. Mine got my out of my reckless driving ticket for my accident, and got someone I knew out of a DUI with only 6 mo license probation.
Heyyy from what i remember about traffic laws, is that even though the vehicle making the right hand turn DOES have right away, that vehicle must choose the lane that is closest to them, which states the driver cannot swing acrost two lanes, this is due to the fact that when driving on multiple lane roads accidents dont occur when left hand turning vehicles have the opportunity to get out of the intersection safetly while having their own lane to turn into as, which would be the CLOSER lane to them as well. So the vehicle that made the right hand shoud have stayed in the right lane, while you could have legally turned into the lane left of her and the two of you would have been fine. However you didn't state how far away from the intersection when she pulled into you lane, nor did u state if it was an improper lane change, like no signal or switching lanes to quickly to avoid. She did cross her lane hitting you, even though she was ahead of you, you still might be at fault though.

You had a green, she had a red, you were in the proper lane, she merged into you, she is at fault, and it has nothing to do with her being a female and everything to do with her probably not paying attention.
An attorney will not be needed if either insurance company knows what theyre doing. Why is everyone so quick to get an attorney nowadays ?!?!? They are one of the reasons insurance rates are so high. I could continue, but I must get to working dealing with attorneys that have filed stoopid lawsuits against the company I work for.

tehre is a similar light where I work, every ****** time I make a left hand turn out of it I get ******** who try to cut infront and make a right hand turn. i usually gun towards them and make them stop in their tracks and look like morons, i then give them the finger

everything on the diagram is to scale to my best recollection. it happened probably a few feet from the intersection as i already finished my left lane turn.
im 90% sure she didn't signal since she was so careless about making a curb-hugging turn and swung out wide. considering that she drove an SUV she also may have been careless about the visibility of my car since it sits much lower than hers (i ride stock height) which means she didn't check her mirrors before making a lane switch assuming i would let her overtake me automatically.
and as close to the intersection as the crash was, i can deduce that my left turn took much longer than her right turn seeing that the light was green for her and required her only to slow down, but not to a complete stop, before making her right turn.

Looks like unsafe lane change on her part based on your diagram and recollection of the incident. She left her lane and entered your lane to be one with your car.
I am not sure about California laws, up here we have a law called Insurance Act that the insurance companies use to determine fault minus the attorneys. http://www.e-laws.gov.on.ca/DB...e.htm

(4) If the incident occurs when automobile "B" is changing lanes, the driver of automobile "A" is not at fault and the driver of automobile "B" is 100 per cent at fault for the incident.

Attorneys bring more bullshit to the table than necessary more often than not. If they werent just out to make a quick buck I might agree, but they are and I dont.
