liability issues anybody??? waiver?
Just wondering if anybody here ever uses waiver's to curb any possible liability issues. I have agreed to do a motor swap on a street driven motor cycle but i am a bit nervous about being liable IF something were to happen.

You pretty much are a wallking/talking waiver if you drive a street driven motorcycle. It's alot different than a car where you can easily hurt more than just yourself. Lawyers don't have much to go on when someone kills themselves on a motorcycle. Especially with no witnesses besides the now dead rider.

I hate to say it, but if you don't feel confident in your ability, or the parts you are given to work with, don't do it. I've done at least 20 swaps for people and never thought twice about liability. They hand me an engine, pay me cash to put it in, and I'm 100% confident that my installation will not be what causes the engine to fail.
But if someone handed me a box of parts and said I needed to throw together a motor with mounts that are sagging, oilpan sitting too low, etc, I would tell them to go home and never let me see them again. Cover your own *** and make money where you can without putting your *** on the line.

I am talking about a weld cracking or tubing material around a weld cracking causing an accident. Not about engine reliability.
I talked to my cousin who is a lawyer, he said waivers don't really stand up in court.

Not sure how it works in Canada.
Poor performane is not an excuse, hence malpractice suits against doctors.
I'm not sure a waiver would help, but insurance would cover it.
Seems like insurance would not be cheap though.
If it seems sketchy, maybe walk away. Doing the install opens you up for alot of liability, versus just making a part for the project.
