First off I was warned by a moderator who caught wind of this to try to resolve things with Nick as he is a powerful moderator. Later I was advised by the same moderator that posting anything negative about a moderator is against the Honda-Tech.com Terms of Service.
Per H-T TOS: "Do not post complaints regarding Honda-Tech, the software, the staff or the servers in a public forum. Email or PM a moderator or administrator"
This is not to negatively reflect on Nick as a moderator, which I believe he does a good job of, this is solely to let people know about whats been going on. I believe I'm one fo the few, if not the only, person who has ever had a problem with Nick as a seller.
I'll give you a brief break-down before I post the saved PM's I have. I also have Screen Captures of all these PM's saved on a removable hard drive just incase I am banned or my account is deleted or tampered with.
August 2006 I saw that Nick had a used AEM EMS with CD for sale for OBD-I Hondas. It had low usage on it (under 8k for sure, I think it was closer to 3k miles). The asking price was reduced to $850 shipped, so I contacted him via PM about it (these were not saved). I made him an offer of a deposit followed by one payment and he agreed to this. I sent him a United State Post Office Money Order for $500 on August, 14. I got the next MO for the balance to him within a month. I don't recall exactly when it was sent, but I know it was within a month, which is longer than I told him it would take for me to get it to him.
Once he confirmed he had the balance, he said he would ship the EMS to me in the next week (via PM, not saved). I got busy with work (was working three jobs at that time) and never realized I never got the EMS (didn't need it until Spring when I would be tuning my build). I sent Nick a PM asking him when he was going to ship it out. I was never informed the EMS was shipped, never provided a tracking number, given an excuse why I couldn't have the tracking number (which his excuse was shot down by my UPS store), insulted, etc. It's been close to a month since the last time he said he would refund my money and I have no money. Now when I tried to PM him today to find out whats going on, it turns out he has blocked me from PM'ing him. I've talked to several respected people about this while it was unfolding so they can vouch for it from my side, I'm sure Nick will have the same for his side of the story. I also have vouches from users on here who operate businesses, who can vouch for how I take care of things. I will leave them out of it unless they decide to chime in. All I want is to get the EMS (unlikely now), or have my money refunded as he said he would (every dollar). If he wants to provide me the tracking number then we can probably work out some lesser refund (only if the tracking number is still good and I can find out what happened to the EMS). (6:23 PM 12/8/2006) Evil Nick M: Ok, since I am kinda friendly with the branch manager she seems to be going above and beyond. She tracked via my credit card, the delivery which I wrote out for 123 Brittony Dr Gray, TN 37615, their records show a delivery to Brittony Dr, but not 123 Brittony. But that doesnt mean anything yet. She said if in fact it got "lost" and didnt arrive to you and I want to make a claim against it since there is no insurance, the max I would get is like $100. She said she would put it right through since I'm there often. She put in a request to find out if its laying around somewhere and didnt get returned or if something else weird happened.
Worst case, I get a check for $100 and fwd to you. Best case its sitting in some UPS depot and someone on their end dropped the ball. And there is the off chance it was dropped at the wrong location all together.
I'll know more on Monday, she has my cell # to give me a ring.

I'm going to go down my street tomorrow and see if anyone got it, but that is unlikely since whenever that happens they always bring it to us.

She said everything on their side of things seems normal, but it wasnt shipped to your address specifically, the destination is just the road. Do you live in like suburbs? Middle of nowhere?
She said she could get me a $200 refund basically as a favor and thats it. She has nothing else to tell me. There is nothing on their side of the fence that indicates something went wrong or wasnt delivered. She said that its also so long after the delivery that ordinarily they would question fraud.
I dont have any reason to believe its fraud, i didnt check any vouches for you, but I dont think I have to. I believe you.
I dont know what we're supposed to do now.
This happened to me once about 7 years ago. ******* sucks.
They just say tough ****.
I'll give you the $200 for sure, and an extra $200 out of my pocket, that way we both only lose $400.

To put it bluntly, this is your problem. Not mine. I realize people make mistakes, so I took the time out of my day to try to do you a favor. I offered a solution. I didnt buy something from you. I didnt forget to get insurance, or a signature, or anything else. I didnt forget I was expecting a delivery and to follow up about it until almost 2 months later. I was extremely patient even waiting for the payments to arrive. I have gone way above and beyond anything I needed to do to help out. I even offered to give you 50% back. I cant see too many people doing that.
I am not going back to the UPS store this week, nor am I calling again. I am done bending over backwards with this transaction that was started ages ago. I dont have any obligation to continue talking to you about this. I offered to do the right thing for both of us. I think thats more than generous. I dont understand why you are trying to take advantage of me.

Yes I forgot about the package for a while and didn't check on it like you said. But you also never told me that you had shipped it. All you told me was that you would be shipping it in a week. No notice was given that it was shipped, and no tracking number provided. I need the tracking number, and I need it soon. I hate to do this, but I will give you until the end of the week (Friday, 12-15-06) to get me the tracking number and address of the UPS store you shipped it from before I take any actions. I'm sorry that its coming to this but I cannot take a $450 loss and still have no AEM EMS.

I have been here for 6 years, a mod for almost 4 years, and have NEVER had a problem with a transaction. EVER. Until you decided to forget some basic life skills.
You dont want to take a $450 loss? If you didnt want to take a loss of $450 then YOU SHOULD HAVE GOT INSURANCE AND THOUGHT MORE THAN 5 MINS AHEAD! Thats YOUR responsibility and and you should have thought of that the first time around.
From asking around quite a bit, you are apparently a total flake and have been irresponsible before.

That way I can go to my local office and try to find out where it was delivered to, and hopefully have it returned to me. If you'd rather refund my money than provide me the tracking number thats fine. However if you give me the tracking number and I can locate and claim the EMS, then that would save you from refunding me.

subscribed...Chris is a good guy, he wouldn't harass anyone, and as anyone can see, he is only asking for a tracking #, which is something that should have been exchanged at the time of shipment....I hope everything works out Chris.

Thats pure bullshit.
IT IS THE SELLERS RESPONSIBILITY TO INSURE PACKAGES. IF DAMAGED IN DELIVERY IT IS SELLERS ITEM. THE BUYER ISN'T RESPONSABLE UNTIL THE PACKAGE IS SIGNED FOR.
Sorry I normally don't use caps but I do have over 2000 items sold on ebay. Insurance is to protect the seller from stuff like this and stuff like this is why I use credit cards. Paypal sucks to for these things.
If you had used a CC then you could file your own damn claim.

So you are gaining 1200.00 instead of losing 400.00 how is that even Math?

Again, completely the sellers/shippers responsibility to get insurance on HIS item.

Plus how the hell is the buyer gonna get insurance when the seller is the one purchasing/printing off the shipping label. Insurance is free up to 100.00 and only like $0.35 each additional 100.00 or something minute.

IT IS THE SELLERS RESPONSIBILITY TO INSURE PACKAGES. IF DAMAGED IN DELIVERY IT IS SELLERS ITEM. THE BUYER ISN'T RESPONSABLE UNTIL THE PACKAGE IS SIGNED FOR.
Sorry I normally don't use caps but I do have over 2000 items sold on ebay. Insurance is to protect the seller from stuff like this and stuff like this is why I use credit cards. Paypal sucks to for these things.
If you had used a CC then you could file your own damn claim.

According to egay then yeah it can be a buyers option but that still is irrelevant.
The person shipping an item is responsible for purchasing said insurance and is responsible for the item being shipped. If the box is mangled when it gets there then there may be a dispute with usps, fedex, ups or dhl. But in a case where lost or stolen items than the buyer is not responsible for anything. It could have been labeled wrong address or illegible.
Like said above. I am not here to take sides or cause beef. I am a total neutral party in this but I do know a whole lot about shipping. I am a warehouse manager as well and I am in charge/take care of massive shipping, although that doesn't play into the fedex, ups type stuff.
I am only here to give the facts that I know and will try to look for the proof to stand behind what I have said ^ because I know it exists.

You could have handled this like an adult from the beginning. Like not waiting 8 weeks to pay me for it, then waiting more weeks afterwards to claim you never got it. Then demanding to expletive me over.
