I received a call Feb. 2 from Brice offering to sell me his 2006 AP2 headlights minus bulbs and ballasts. He had seen my request in the WTB forum. He originally wanted $750 and if I wanted to pay via credit card or paypal, an extra 3%. We negotiated until we agreed on $700 shipped with no extra 3%, to be paid via paypal. He gave me an email address of d_lamano@msn.com and I sent the payment at 12:28:53 PST. We speak over the phone and he confirms the payment was received. A week or so go by and I haven't seen the headlights or heard anything back. I call Brice only for him to say that they had not shipped out because he had to wait for the money from Paypal and that he had used his buddy's/co-worker's paypal account. Said he would have it in the next day or so and would ship them very soon. A week or so more goes by and still nothing. I call for him a few times and leave messages because he is not in or not available. Finally, on March 9 I receive a cashier's check for $679 and letter with the following: (this is copied word for word on the typed letter)

Hi,

I'm sorry for the delay on you headlights, but I had decided that I am going to sell the S2 for another. Enclosed is a cashier's check for the amount received:

Headlight Price: $700

Subtract Paypal Fees: 3%

Thanks for you interest but I'm sorry that this deal didn't work out

I called him after receiving this and informed him that this was not acceptable. I should not be paying a 3% fee because it was agreed that the headlights were $700 shipped and that is what I sent. He said he didn't feel like he should refund me $700 because that's all he got from his friend who's paypal account he used. I gave him several opportunites to make amends and I informed him I would post here, and on other forums, if he didn't return the $21 balance. I asked him several times if he would return it, "yes or no," and he refused to answer and just kept saying he didn't receive $700 just the $679 and that he didn't feel he should lose double. After asking several times and getting the same reponse it was quite clear he was only trying to avoid paying for fees he incurred by backing out of the deal and I hung up.

That guy's obviously a total tool, it is simple to just give the cash back to his friend and have the friend refund the PayPal payment, then nobody would have lost any money at all.

Besides, whoever backs out on the deal after the money has changed hands should be the one responsible for eating any losses.

Actually, I think you're lucky you got it all back except the $21. These forums are loaded with scams were guys lose hunderds or more so you did well. Nevertheless, I feel you're entitled to it all.

file a complaint w/ paypal charging that you never recieved the goods.. try not to mention that he sent you a check though either.. hehe..

you might get lucky and get your $700 back and the scammer can deal with his friend later on..

To the thread starter,

I apologize for what has happen, I had told Brice to send you back the full amount, but in the end it's his choice of what he does and I can't force him to do the right thing.

on paypal its has a refund option just in case something goes wrong and no one lose's money either way. Its a full return!

I'm think that Brice's friend w/drew the money from his PayPal account when he received it. Usually, there's a option to do a complete refund. If he would've done that, no fees would've been charged.

It shouldn't be your friend's choice because it wasn't his money. The payment was being sent to you, so it's your responsibility. Personally, I think you're the one who should be absorbing the $21, not your buddy. It's not xlevel's fault that you reneged on the agreement after he sent payment.

Reneged on what agreement?!? Money wasn't sent to me, it was sent to Brice. I did not "arrange" the transaction, Brice knew I had the account so he wanted to use my account, that is the only connection I have with this problem. Why should I be the one responsible, because it's my account? Brice knew what he was doing, and I told him what was going to happen, I'm not going to be responsible for his actions I'm not his Father.

Would you pay for your friends fault? I bet you would'nt...

you gotta have a bank account inorder to be a verifed user on paypal! someones bull$hiting here...you cant make transaction w/o it!

that is exactly what i would do untill i recieved my money! this is wrong either way and doesnt reflect a good image on jhpusa in no way possible! i know i wont buy off someone i cant trust

Sorry about that. I think there was some confusion as to who's selling the parts & who's Paypal account it is. I guess this is how the situation went:

1) xlevel sends $700 to your Paypal
2) gump w/draws $679 from Paypal to give to Brice
3) Brice reneges on the agreement & decides not to sell to xlevel
4) Brice refunds $679 to xlevel (because that's what he got from gump)

You don't need to cover for your friend. He's responsible for the $21. You just got caught in the whole situation because your Paypal account was involved. I'd reconsider if Brice asked you for this favor again.
