Default break light going on/off

I noticed when the car has been cold lately that the Brake light continues to stay on. The e-brake handle will be down and sometimes when its off and I start to drive while in first gear, it will go back on. Does anybody know what could be causing this and how to fix it?

just one more quick question....could the light be that the pads are going its a 2001 LS, but never knew there was a sensor of any sort that told you when your pads were going

there was actually a TSB by acura for this problem..usually its a sensor in the master cylinder so usually you can just open your master cylinder and the problem will go away for a while but what is actually wrong is that there is a white filter in the master cylinder and that usually gets clogged up and causes your brake light to go on..so just replace that..i think it was around $10
