Default NEVER LOVED OR HATED SOMETHING SO MUCH AT THE SAME TIME!

My Sob Story:
Bought, 97 Acura Integra Type R #362

Mods:
Custom 4-1 Header
Trust Exhaust System
AEM SRI
Comptech ECU
Koni Full-Coilovers
It had a black rear bumper
and a cracked front lip, but that was about it as far as problems.

my insurance company (Farmers) who has been charging me $320/month, thinks i pulled insurance fraud. so i have been under investigation, i have to provide tons of information, recorded statements under oath, etc. so... 6 MONTHS AGO, car was stolen. i have yet to be paid out for my car, and they havn't given me any answer as of yet to if they are going to 'convict' me of insurance fraud, or just pay me out like they are supposed to. so i have been making a $320/month payment for insurance for the past 6 months, and $300/month for the car payment. basically 600/month for a car i dont even have.

here are a couple 'before pictures'

it was stolen in april and found after about a month, missing rear seats, valve cover, spoiler, misc engine parts, and little parts here and there. i drove it for ONE week, went to arden mall to exchange some shoes with a couple friends and my girlfriend. My friend and his g/f leave before us and calls me: "hey you left already?" me-"no, why" him-"your car is gone" me-"stop bullshitting me" him-"no serious its not there" me-"f&^$, ok i'll be out there" go out there, car is gone. like 3 months later, car is recovered AGAIN...

here she is now...

missing everything except doors. engine, tranny, suspension, rims, trunk, door panels, whole interior, etc.

after seeing the car at the towing yard, Farmers Insurance, lets me know that i have to pay for the storage fees, towing fees, and now i need to tow and store it so i dont get charged $40/day for their storage fee. and they will not be helping/paying me for this

i am in debt, im short on bills every month, i have a hard time getting to and from work because of the car issue...etc, etc, etc.

moral of the story, DONT USE FARMERS INSURANCE....

i have never loved and hated something so much at the same time.

There's not many cases where I'd say get a lawyer and sue the pants off someone but this is one of them.

It's really sickening how some insurance companies operate. I mean literally any insurance company out there could deny anyone's claim whenever they feel like it because they know how big of a headache financially it would be to fight them in court. Sadly your insurance company seems to have taken that route.

What grounds do they have to file an insurance fraud claim against you? You'd have to be a pretty stupid insurance scammer to fake having your car stolen TWICE within just one week of getting it back. I also assume you called the police when it was stolen from the mall correct (I don't know the name of the place you mentioned but I just assumed it was some sort of shopping center)? Does the insurance company really think you'd commit the fraud in a mall parking lot of all places?

I really hope everything works out for you.

contact the bbb, and contact your state's insurance fraud agency against the company, that usually works in your favor...

when i cancelled my progressive motorcycle insurance they tried to pull some bs fee of like $100 bucks because it was a "NYS law" that they could. I contacted the agency and the fee was dropped in an instant...

Unless they can PROVE you stole it they can't put you in this situation. And if you didn't steal it yourself theres no way they can prove it, so go raise some hell at the corporate office and bitch them out. They can't go above the law and you are innocent til proven guilty, so in all reality they should HAVE TO PAY you out. And another question is why the FU&K are u still paying insurance on that car??? i understand having to pay the car payment, but why insure it? Just tow it to your house and leave it uninsured in a garage.....

doesnt seem like you are being too smart about this at all. sorry for being harsh, but there is no way in hell I would insure that car.....not like someone will steal it in that condition.

I used to work for State Farm for about 5 years. I am still a licensed IL insurance agent.

Two things:

1st - If Farmers informed you that you are required to pay the insurance premium after the theft then that is a big NO NO in the insurance world. That vehicle is not drivable, nothing else can be stolen off of it, so therefore there is NOTHING left to insure. Unless you plan on rolling the vehicle into a walking pedestrian.

2nd - Contact Farmers corporate office regarding the alleged "insurance fraud" incident and find out what grounds they are basing this on. If you are given a run around its time to take matters into your own hands. A lawyer will take a case like this for a minimal charge or maybe pro bono because there "could" possibly be a lot of money involved should the insurance company have to pay out. I would even go as far as contacting a local newspaper or station regarding this if in fact you were not involved in the theft (believe me, the media will get to the bottom of it very quickly).

Let me know if you need any help, I still have my insurance law books around.

thomas.stasiek@yahoo.com

Good luck.
