yeh the P28 has been chipped with a skunk 2 H22 program..but i don't have an O2 sensor....would that cause the VTEC not to activate?..correct me if i'm wrong but on the JDM H22's isn't there an O2 sensor right before the flex pipe?

your car should still engage vtec without an o2 sensor. and i believe if you run a knock equipped ecu without a ks it will go into limp mode.
