Default It finally happened..its been 7 years get off the whole R thing!!

So I had the R out for a beautiful night since its my only night home with her for the week. I went over to the girlfriends house. We decide to go get some new Vanilla frosties from Wendy's after about 2 hours of being there. I volunteer to drive since I havn't had a lot of time with the R anyhow.

Well on the way back, this guy tried to screw with me. I ignore him for a very very long time. I just go to the left, he comes right up doing the whole edge ordeal. I let him do it for atleast 6 miles or so. I finally decide to get behind him and just follow him but he then decides to tap the bakes every 5 feet. I get pissed off, swirve to the left lane, and try to make an agressive pass cuz I was getting pissed off. Well wouldn't you know it, cop lights start comming in the right and I get a $281 dollar fine for Highway street racing. The cop even claims that he was following me for miles and I was doing everything completely fine except for those 10 seconds. I'm outraged. 1 just for my bad luck. 2 because i was being profilled by the cop probably because of my large wing (WHICH IS F'N STOCK!!)..and 3 because of this *** who thought I would race him for 10 miles just because I own a somewhat of a legend in the import scene. I'm fighting it hardcore but I just felt like I had to do a little ranting to people who know what I am talking about.

If this has happened to any of you, how did court go? If I end up being stuck with the fine, does anyhow know how many points I get and will I lose my license?

...If I lose my license for something like this I will be outraged. I love the ITR, but **** like this makes me want to go debadge everything, put on a 4 lug, and take the wing off so I am no longer looked at like a stupid ricer 16 year old. I'm sick of this ****.

The other guy actually got pulled over too but I don't know what happened to him. Are you sure I would lose my license. I was reading the vehicle code for pa laws and it states that the penality is

(d) Penalty.--Any person violating this section is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $200.

It doesn't state anything about losing my license. Can anyone clarify on this?

And what do you guys think my chances are in court?

You CAN loose your license, at least here in iowa. But, if you have a good record, that will better your chances. Also jjust explain the situation to the judge. I am sure they will drop it.

It was my first affense for anything so hopefully that will go in my favor. I'm usually a damn good driver with good patience but this guy just rubbed me the wrong way. The worst part is, after 5 seconds of the guy trying to catch up with me when I tried to pass, I hit my brakes instantly, turned on my right turn signal, and just followed. I even told the cop the complete story of everything and then the cop wrote on my citation that I admitted to having road rage problems. Like what a f'n ***. Doesnt that contradict my whole road racing then? Road rage for 5 seconds or street racing? I don't see how the coexist together.

I'm just confused on the whole thing as this is my first tme in trouble with the law on any accounts and would just like to hear some opinions on it. thanks a lot guys.

man, that really sucks, but there's nothing that says you have to stay on the freeway with this guy... that doesn't happen to me very often but when it does I find it helpful to just take the next exit, wait a minute to get some distance and then get back on the road.

Tell the judge this. Probably your best bet, not a lot more you can do.

sorry to hear that happened to you. don't know about your state, but in CA...you won't lose your license...b/c if you're supposed to, you wouldn't have it with you now. cop would've taken it from you on the spot. if it's your first ticket, you don't get a point if you go to traffic school. if you fight it in court, you will lose 100%...unless you get really lucky and the cop doesn't show up. if i were you, i'd just pay for the ticket and go to the traffic school (if your state law is same as mine) and don't let some punk ricers get to you next time. good luck.

buddy, here in canada they wanna jail you for 30 days and impound (crush) your car for street racing. Canada continues to make these stupid fucken laws, i dont get it though, its ok to steal cars, but u cant race them...go figure

My suggestion would be to sign up for driver improvement clases NOW. And talk to a traffic court lawer, because laws vary state to state.

When you go to court to fight this explain your case as the lawyer advises and tell the judge you have all ready started to improve your "road rage problem" with driver improvement.

Anyway, I think you may be in some trouble with the whole license thing. I'm pretty sure street racing is an automatic 3 months around here, especially in our area.

The EXACT thing happened to me 5 years ago here in CA state and this is what I did:
1. Got a lawyer as this is required by state of CA for "misdemenor" case.
2. Provide our lawyer with a brochure of the ITR showing that the large wing is in fact a "F'N STOCK" part that came from the factory. This was the key point of my victory in my case. It show the judge that the cop was over-reacting when he see a "sup-up" car, factory equiped or not.
3. Be hornest because judges are people too.
Last but not least: MAY THE FORCE BE WITH YOU

I thought street racing was just considered "hazardous driving". Hazardous driving in indiana signifies so many points i forget the number.

3367. Racing on highways.
(a) Definitions.--As used in this section the following words and phrases shall have the meanings given to them in this subsection:

"Drag race."
The operation of two or more vehicles from a point side by side at accelerating speeds in a competitive attempt to outdistance each other, or the operation of one or more vehicles over a common selected course, from the same point to the same point, for the purpose of comparing the relative speeds or power of acceleration of the vehicle or vehicles within a certain distance or time limit.

"Race."
The use of one or more vehicles in an attempt to outgain, outdistance or prevent another vehicle from passing, to arrive at a given destination ahead of another vehicle or vehicles, or to test the physical stamina or endurance of drivers over long distance driving routes.

(b) General rule.--No person shall drive a vehicle on a highway in any race, speed competition or contest, drag race or acceleration contest, test of physical endurance, exhibition of speed or acceleration, or for the purpose of making a speed record, and no person shall in any manner participate in any such race, competition, contest, test or exhibition.

(c) Permits for special activities.--The department or local authorities within their jurisdiction may issue permits for special activities which would otherwise be prohibited by this section.

(d) Penalty.--Any person violating this section is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $200.


and if you were passing on the left it says this:

3303. Overtaking vehicle on the left
Note that if a vehicle speeds up when you pass, they are guilty of RACING in PA per 3367! No one wants that in their record.

(a) General rule.--The following rules shall govern the overtaking andpassing of vehicles proceeding in the same direction, subject to the limitations, exceptions and special rules stated in this chapter:
(1) The driver of a vehicle overtaking another vehicle proceeding in the same direction shall pass to the left of the other vehicle at a safe distance and shall stay to the left of the other vehicle until safely clear of the overtaken vehicle.
(2) Except when overtaking and passing on the right is permitted, the driver of an overtaken vehicle shall not increase the speed of the vehicle until completely passed by the overtaking vehicle and shall give way to the right in favor of the overtaking vehicle on suitable signal. (b) Suitable signal defined.--Suitable signal for purposes of subsection (a)(2) shall be as follows:
(1) At all times when head lamps are required to be lighted according to section 4302 (relating to the period for requiring lighted lamps), an audible signal or the intermittent flashing of low and high beams except that the use of high beams shall not be permitted when a vehicle is approaching from the opposite direction within 500 feet.
(2) At all other times, an audible signal.

Note, that you likely may need an attorney if you are cited under this. No attempt is made here to practice law. More of a points that should be asked about when discussing it with the attorney. There maybe other applicable sections too.

according to the pa vehicle code book under section 1532 "racing on highways" its a suspension of your licence for 6 months.

I had no idea that you could be charged with RACING for speeding up to pass another vehicle.

What about Grandma going 10mph under the speed limit in front of you in a passing zone?

I hate public roads.

Ok, I guess your 18 , thats really not that old. But anyways, in the state of VA you can ask for driving school and the ticket/points will go away. The point for a wreckless driving ticket in VA is 6!!

I am currently 18, but by the time this hits court I will be 19. I am getting an attorney today. I am scared shitless that they find me guilty, I lose my license for 6 months, and my insurance company drops me. That would be worse case scenario.

So you never made a hard pass on the left? Either in the R or any car? I believe everyone does it once in a while, I just happened to get profiled and thrown a huge fine.

i would tell the judge the whole story, be polite, very polite, be sure to say, "yes your Honor...no your Honor" not many people like to kiss ***, including myself, but believe me it goes a long way.

Man I really appreciate the patience that you had in that scenario. It is real hard to calm down with someone doing **** like that.

The chance of totally getting this off the hook is minimal, since that pig was on your tail all the time and saw the whole thing. But the fact that he was following you for miles until u got pissed off for 10sec may help u in fighting off that street racing thing. GL for you.
