Default going to state referee

So i got a smog violation ticket and already set an appointment with the state referee. My question is that do i really need a heat shield for my stock headers? Everything is stock and ready to pass the ref but i dont have the header heat shield. The motor is a stock d15b7 with stock intake, stock headers, and stock exhaust in my 93 civic.

One more thing...i recieved a letter from the court stating that i have to pay a $350 bail with the corrections or $480 without the corrections. So if i correct everything and still go to court, i would still have to pay $350?? or might i just have to pay the $10 processing fee???

thanks in advance for any positive input

not having a heatshield is fine, i didn't have mine whey they tested mine. As for your second question, i'm not sure. I received a letter too but it was a total of almost $600 bail. I just paid the $10 fee after i passed the ref and showed it to the court.

yea, thats what happened to my friend.
i think if you pass the smog check and bring the proof to court they will dismiss the case.

how do you get a smog violation?

does a cop just know by the smoke or smell?

No, they dont know by the smell. They usually give you the citation if you have any part thats modfied without a carb sticker, or if they just wanna be a jackass

check your speeds. moving violations in nor-cal grounds for popping the hood. other than that, you do have rights to keeping it closed, yet they can still just refer you to the ref.

You pretty much can not keep your hood closed. a PD can dispatch a chp and they will authorize you to pop it. If you choose not to matters will only get worse. CHP's are the only law that have rights to check under your engine bay.

you do have rights with regard to keeping your hood closed-- moving violations are grounds for popping the hood, although there are others. i was asked to pop my hood during a traffic stop (my headlights needed to be adjusted, so the chp officer pulled me over because of this-- said they were too dim <still don't see the point in pulling me over&gt. the officer asked me to pop my hood and i said under what grounds? the officer then asked if i refused, and i stated i did. needless to say i was referred to the ref, yet i fought it in court and and was let off the hook. your hood cannot be popped for just any reason, only those stipulated in law. again, your best bet is to refer to your local laws regarding this matter and see where you sit.

a new law was passed in california, i believe at the beginning of this year that authorizes the chp to inspect vehicles currently in repair facilities. it's under the pretense of seeking out car owners who are utilizing stolen parts, however should they deem some parts to be in violation of emissions laws, they can refer these vehicles to the ref. just a heads up for anybody taking in vehicles to have any work done.

congrats on passing! After i passed i went to the west covina court but they sent me on a wild goose chase! There's a sheriff's department in the court which I had to go to because I had another violation that needed to b signed off but a regular police officer is not able to sign it off. They looked at the violation and they couldn't find that violation in their books lol, so they sent me to another place in the court but that's just to pay fines.

All in all, i went back and forth with them telling me **** until they told me to just go to the chp so i had to leave the court and get back on the freeway to go to the nearest chp. They signed off the ticket and i went back to the court to pay the $10. All that took almost 3-4 hours to get done.

yeah...what a hassle.

i was cited with the smog violation ticket after i was pulled over for my car being too loud. i was running an open exhuast so there was no exhaust there. cop told me to pop my hood. i did without hesitating. i admit that i didnt know what to do. it was my first time being pulled over. when he popped my hood, there were no intake there as well. all i had was the simple aftermarket intake filter strapped onto the throttle body. he then wrote me the ticket for smog violation on top of my car being too low. but the smog violation was mainly for equipment that affects your car's emission (stuff that i had and didnt have). but i guess that getting pulled over was inevitable because i did sport the open-enhaust on the streets.

i had my court arraignment today. things didnt go as planned because i still had to pay $385 after i corrected everything on my smog violation. judge said that it was because the violation is non-dismissable. just wanted to share this.
