there is supposed to be a metal washer between the rubber bushing and the bolt. you use an allen wrench and a monkey wrench to tighten that top bolt.

i did but even though the washer is there the bushing still turns, plus you cant torque the bolt with an allen wrench and a monkey wrench, you have to use a ratchet. i tried torqueing it to 43lbs but nope cant do it. do i have to torque to 43lbs or could i just leave it hand tightend?

I wouldn't leave it hand tightened. I'd try everything you can and then pop to a car garage and get them to do it for you if you're still struggling.

Tightening torques aren't a "suggestion".
