Default not bike related, what would you do?

Hey guys:

I have a question for you all, wondering how you guys would treat this circumstance.

I advertised my Integra for sale one night because I was bored and so I put a ridiculously high asking price on it, assuming I would never get it. Low and behold a woman calls me. She drives out to look at it, likes it, offers me full price for the vehicle (like one of those scam emails you get). I say sure. She goes to bank, gets me a $5000 deposit because she wants me to stop trying to sell it. I say fine. She says it will take her 5 days to get the rest of the money. Again fine. I take the money to my bank, verify it is real and cash it. This is 12 days ago. I went and bought myself a 4runner 3 days ago hoping she would take the car soon. I have been unable to get in touch with her after several attempts...What would you guys do? I have options of course but I am curious to what you guys would do??

um, how did she pay you, with a casihers check or something?

i wouldnt count on the money being there, they can reverse **** after youve cashed it

i would NOT do anything, post her email, sounds like a scam

...She paid me with a bank draft. I went to the bank and had them call her bank to certify that it was legit and it all checks out, Ive had it in there for almost 2 weeks now. I asked the bank teller if she could stop payment or anything on it and the teller told me they could not stop payment on a bank draft as the money as already been taken from their account, unlike a personal check.

I don't have her email, shes local to me, she called me as my phone # was in the ad. The car is still sitting in my underground parking and I hold all the keys and registration so not much she can do.

the_head:

I still have the money, its already been spent to pay off my line of credit. she doesn't have the car.

That's pretty weird. But cash is cash? I'd prob give it some time to see what shakes out, things may have changed and chances are she'll want some of that money back.

It is really wierd....who gives someone $5000 and then runs away from the person they gave it to....

Want it back? good luck, she bought herself half a car..She might want it back but I don't have it anymore.

I believe she has 3 months before you can resell the car. I would probably check on that forsure though.

I doubt you can really do anything but just wait and hopefully you can sell it come that time.

lucky you. sounds like you just scored yourself an easy 5 grand.

if i were in your situation, i would try to get a hold of her ANY way i could. $5000 is a lot of money to me. it would just be best that you contact her in any event. not at all saying that you should return the deposit though. did you two discuss the terms of the deposit at all?

Yeh I don't know man, wierd situation. $5k is a lot of money to walk away from... Im going to look into the legalities of this when im at work tomorrow. Ive tried to call her several times by all methods I have. Ive heard that after 14 days the "buyer" forfiets their deposit. Thats what a dealership told me they do if someone doesn't follow through on the deal and leave a deposit, they have to be able to sell the vehicle...

Heh, an amatuer scammer I was her first and she screwed up. that would be awesome. one of my collegues's husband is a baliff so i am gonna talk to him once she gets in this morning. I would be stoked if I could sell this thing again legally.

ah, i don't know what the laws are in good ol canadia, but talking to any lawyer or law school friends you have might prove helpful. "contracts" are usually the first classes covered in law educations.

if i were you i would write down somewhere the verbal agreement you guys made when she gave you the money. I THINK she's the one who is in bad shape for not asking for a reciept or any written contract when she gave you the money, but it'd be a good idea to be sure.

You don't have cash in hand, bad things might happen if the other party decides they don't want the car afterall. So, try and get something signed by her just in case. Even though it's after the fact, it could help you if she does change her mind.

Yeh I should written up a contract, but who does that when they sell privately =p

I would like to get something signed by her, but as i said, I have had NO WAY to contact her. Yikes I hope this doesn't get ugly, ****. I would be able to get her the money but it would take me some time and sence ive been waiting on her for some time now shes either going to wait, or buy the car.

Not that shes asking for her money back , so lets just assume she had to leave town for the long weekend or something and shes going to finish the transaction tomorrow

i don't know about other people, but written contracts are a must for me, especially if it's a private deal.
I just sold my F4i to a guy and we did two different bills of sale, and we each got copies. On top of that i've got emails from him with some of our discussions, and those are saved to a folder. It's always nice to cover your ****.

When dealing with money and property, always write up a bill of sale, and go into full detail. Both parties sign. I'm about to take my supposive 'friend' to small claims for 1500, the deuche hasn't paid me a cent of it since February. I wrote-up a bill of sale, stating the payment terms...and I get free law advice since my pops is a lawyer, lol.

Hey ask your dad if there is some sort of term where if they don't purchase the vehicle within 30 days they forfiet their deposit??

Ive sold several different vehicles and never had a problem with it. this isn't a problem, but as you can tell it does have the potential to end up that way.
