Got in accident, other guys fault (he had NO INSURANCE!)
so I am just driving down the road today, minding my own business when this guy backs up into the middle of the road. My choices were hit him or the other car coming head on. This guy had a revoked drivers license and no insurance. I left a few black marks on his bumper of a 1998 ford contour. This is what happened to my car:

$2202.33 worth of damage with out pulling the bumper off to see if anything else is wrong. Oh well.

Try to work out a deal outside of court first, if not sue him for damages. Make sure the police report is right and you have plenty of copies.
oh yeah the cops came and did a report and I just looked his name up on iowa courts online and he is in there 14 times. He has been caught 3 times driving with no license and 2 times with no insurance. just my luck!
i am thinking about sending him a registered letter saying pay my $500 deductable or I will take you to court and prob get more than that. what do you guys think

Hell ya
expletive him, why is he not in jail if he has been caught so many times? Its no wonder he got no license and insurance, cuz it sounds like he sucks at driving, PERIOD, and no insurance want to cover him

I wouldnt send him anything without talking to a lawyer. I would be demanding full cost of repairs + medical (if needed) + rental car + lawyer fees + time and agrevation.
The tune of $25,000 sounds about right. It sounds like this guy needs to get his ***** tapped pretty hard before he realizes he cant be out breaking the law like that.

expletive that, why let him off with $500 and then let your insurance go up cause of an accident. They may say it won't go up, but it will, mine went up after my accident that wasn't my fault and the other lady's insurance paid for it. He probably isn't worth enough to pay for your damages but I would still give it a shot in court.

if he has a physical address, any lawyer will be able to use his property as collateral. Go after what's yours, get some extra to send the message. If he skips town, then he becomes a criminal and your still out the money you were originally.
what makes you think he is gonna pay your deductable if you send him a nice letter?

i never really thought sending him the letter would make him pay. but when i end up in court it would be some good proof to the judge that I tried to go after him on my own. I don't know just a thought.
WOW.. i got hit in almost the exact same way.. or at least in the same spot. came out to 2200 dollars worth of damage, not to mention adding the collision with my buddie(he rear ended me) and paid me 2200

i crashed once when my insurance lapsed. i got sent to collections never paid. of course i have insurance now that was when i was much younger
DUDE wtf is wrong with you. You are gonna say forget it because u dont want to lose 50 stupid dollars? Hes liable no matter what. Either hes going to go to jail now, or if he doesnt, the court will garnish his wages and pay you. Even when he gets out, they will still do that.
YOU WILL GET YOUR MONEY NO MATTER WHAT. Don't let someone get away with murder.

yeah I called the cops. I talked to my insurance today they started going after him today, so it looks like I don't have to go after him, my insurance is doing that for me. I get the first $500 back then the insurance gets the rest.
