help....first bad experience with R
well im in the market for a type r and so I went to see one privately. I checked it out and whatever and the car was stock except for a cold air intake. Anyways i take it for a drive and did not rip it at all. I was driving normal, and only hit vtec once in first gear at 6k rpm. Sure enough, 5 min later i got the fucken cops on my *** and i get pulled over. He says i was not speeding but reving. That is fucken rediculous. Then he gets into a debate with the car owner that the exhaust is stock AND THAT ITS TOO LOUD!!!. We were like wtf, were like the exhuast is stock and the noise you heard is engine noise. the stupid 24 year old ******** cop was not convinced so he wrote a ticket. Believe it or not the ticket WENT TO ME!!! I was like its not my freakin car man, im just test driving it to but it, he said it didnt matter since i was driving the car.
So now what? I got a ticket for "unecessary noise" is what it says on the ticket....what do i do next? its not even my car. How do I fight this in court?
Thanks

What a surprise. You argued with him, and probably showed him a lot of attitude. That's the best way to get a ticket.
Based on your description, I would guess that he had not decided to write a ticket at the time he pulled you over, but you and your friend basically talked him into it. (You know, sometimes they are just checking you out and looking for a little respect, which is a lot less expensive to give than paying a fine.)

He's right. You're the driver, so the noise is your responsibility.

The instructions for taking it to court should be on the ticket. Take it to court, and explain the situation there. DO IT POLITELY and don't show "attitude". Dress nice, too.
Good luck.

I've had a cop accuse me of aftermarket paint on my PY, am exhaust which is stock and am strut bar in the front which is also stock. They are told to watch a video which makes them think they know everything about imports. sad but true, good luck

Why are you being such an a-hole? I explained to him probably why he got a ticket, and how he can get out of it; I was trying to help. I know that young people are more likely to be ticketed, but that's not always true. I've gotten tickets when I was young. I've also gotten tickets recently, when the cop pulls me over and says "I figured that car would be driven by some young kid" but still gives me the ticket anyway. So YOUR ASSUMPTIONS ARE WRONG. Stop making assumptions yourself, and stop being such a jerk. I tried to give him good advice. There's no reason to flame me for that.

From more than one of my experiences, no matter how polite/courteous i was, and no matter how wrong the officer of the law was, i still ended up with a ticket. Traffic court can also display the same style of 'law'. If you have yet to experience this, consider yourself lucky. Obviously not always the case, but it does come true quite often for the younger crowd..... or the young at heart.
Police are never around when you need them, and always there when you don't. That unfortunatly is about the only law that holds true these days. Thanks murphy.
edit: (i'd say that quote of yours above was an assumption.... maybe you shouldn't make those.)

My point is, much of the time, they have NOT decided to write a ticket at the time you get pulled over. You have the opportunity to discuss it with them. If they like what they hear, they might let you out of it. If you **** them off, they probably won't. Politeness goes a whole lot further than anger. And someone who refers to a cop as "the stupid 24 year old ******** cop" almost certainly has an attitude about cops that will be pretty obvious and that will hurt his chances in that situation. The assumption I made - that he "displayed attitude" - was based on the words that he used in describing the encounter here. I just cannot believe that someone who goes off on a rant here, using that terminology, would have been polite in the exchange described here. There was ample evidence that would make that the logical assumption to make.
And I had no idea how old the OP is. For all I know, he's older than I am. I don't make assumptions about people based on their age, only based on their words.

Unfortunately Johnny Law profiles a persons appearance and also the vehicle. When I was younger I got harrassed all the f**kin' time, both in modified and unmodified vehciles. It seemed endless. Attitude or no attitude from me.
Now that I am older it seems to have died down. Proper attire is key. Seriously. A ball cap and a hoodie is far worse than a nice golf shirt and styled hair. Different cops have different attitudes too. I've met really nice and reasonable cops but also real f**kin' deadbeats on a powertrip
To the OP: Cops suck donkey *****; my cousin is a cop so I can hate all I want
, and fight the ticket without attitude or bitterness.

P.S. To the OP: When you go to court, it could help your case if you bring with you (a) some diagrams of the stock exhaust system, either from the service manual or from a parts website like Delray Acura, and (b) photos of the exhaust on the car in which you were pulled over. That would be evidence to prove that the car's exhaust is stock.
I think people are missing the point. IT'S NOT HIS CAR. I guess he's supposed to ask the owner to take the car to the police station for him?
Oh and BTW NSXtasy you are way off with the "they usually don't pull you over to give you a ticket". Please inform me why in the world they would waste the time to pull anyone over if they didn't have the intial intention of writing them a ticket or finding some sort of infraction?
I work in law enforcement as you might know (the FBI) and have been pulled over wearing clothing identifying me as such (I don't whip out my FBI creds or anything but my badge might be laying in the seat beside me or hanging around my neck). Even when they realize that I'm such and being EXTREMELY polite I've still gotten a ticket for a minor offense (expired license plate).
I see nothing wrong with questioning law enforcement and being annoyed when they are in fact in the wrong as long as you remain respectful.
We have some local police officers that work with us. I'll try to ask one of them about the situation if I can remember. I mean what if this guy was testing the car from a dealership? The same thing could have easily happened and he'd have no way of proving the exhaust was stock without getting the dealer to take the car to court. I just can't see such a ticket being the responsibility of somebody on a test drive.

im guessin your in the Toronto area, accordin to ur location...im not surprised really, an itr with just intake is loud at WOT, and if the cop is a real dick, he will give u a ticket for unnecessary noise, regardless if its from the exhaust or anywhere else, the noise came from that car, and a car in any situation should drive quieter, well...at least thats how i would think that a cop would see things anyways.

if that's minor, then fix-it ticket for a loud exhaust is nothing. you can't really compare the two offense. like nsxtasy said...it is possible to get out of a ticket (esp. fix-it). i see your point, but i have gotten out of a ticket several times with my R just by staying cool and being apologetic to the cop for something like this. cops don't always pull you over to give you a ticket 100% of the time. i had a cop pull me over once for loud exhaust and we ended up talking about the R for like 10 minutes standing outside of our cars...and no ticket.
to the O.P., even if you lose the case at the court, it's just a fix-it ticket. don't stress too much over it. i guess you've changed your mind about buying an R now?

It's every time I drive my caR (PY > ***). Now when I see a police officer... I go ahead and pull over so they don't even have to exert any effort. The funny part is ever since I got my DCJS card they take one peek at it and let me roll. I'm like "don't I get a piece of paper or something"... they're like "no... that's ok". Full WOT with a JRSC and aftermarket exhaust in a R will always get you pulled over I've found.
Bottom Line is that fun has a price tag.
-edit-
go to court and explain to the judge... 100% off the hook if you're cool.
