well today i took another import off the streets... first it was my del sol in august 03, now my hatch. was on my way to work this morning going roughly 48-51mph and some 70+ year old lady coming the opposite direction turned left right in front of me and i clipped her rear right corner. she is at fault and the police report says so, as well as her claim to be at fault to the officer. plus about 5-10 witnesses say she is at fault. my ins might have expired and am trying to find out if i'm covered... and if i am its liability at best. so for any of u that have been in this situation where you're not the at fault driver and potentially uninsured, what steps did u take to properly get repairs done through the at fault insured driver's insurance company. should i get an attorney or just call her ins myself? advice is appreciated.

btw, its been a while since i posted here due to the lack of maturity that i've come across talking to SOME (not all) people in this section of the forum. try not to lace into me too hard bout not keeping up with insurance and know if i'm fully covered or not... u don't know the whole story.

pics were taken w/ i870 cam phone so they're not the best quality.

here's the hatch...

here's the legend...

driving without insurance (or with shady insurance) is not cool...

But since she's at fault, it's her insurance that will be paying for your repairs (or replacement)... you'll just have to pay the fine for not having insurance.

elderly drivers

I'm sorry to say this but I think after age 60 you should have to take a comprehensive driving test every 5 years to be able to continue driving. Cops complain about people age 16-21 but you don't ever hear them complain about the old lady doing 30 in a 55 or pulling out in front of someone.

/rant

sorry to see such a nice car reach such a terrible end

i think that's a great idea man... yearly checkups on their driving ability. i will be OK w/ it when i'm 70... especially after this incident.

correct me if im wrong, but you want REPAIRS??? ...my friend, god wouldnt be able to repair that damage, let alone the damage thats in your head for driving without insurance. seems you have quite a bit of work done to that car, i guess thats more importaint than insurance also. and incase you havent figured it out yet...if it were 40 times more her fault than it already is...ur still the one without insurance....its your fault no matter how you put it!
wait..what state are you in?? i might be overlooking this...do you need insurance in where you live?

car is IL resident if that makes sense... registered in IL where ins is required. doesn't seem terrible looking @ it up close, but then again i can't look @ the frame or measure it. repairs MIGHT be an option, if not i want compensation.

that honestly looks totalled. Both of them look totalled.

As far as the insurance, hopefully you'll be alright dealing with her insurance company directly.

Similiar incident..
My sister was recently in a minor accident and it was deemed the other drivers fault. My sis contacted the other drivers insurance to pay for some failrly minor repairs on her car but because she did not have insurance, the other drivers insurance refused to pay the claim stating that she would have to go to small claims and sue the other driver for any damages.

Thats the most recent news, so I know shes going to pursue it further whether it be contacting an attorney for advice or representation vs. the insurance co., or if she is going to just end up going to small claims.

Whatever the case, good luck.. and go get some insurance for everyone elses sake.

if the airbags blew, and they probably did, then its totaled.
According to insurance, airbags on the civic cost $3000

My dad got into an accident some six months ago and this is what it looks like.
I've got estimates from three bodyshops, plus a few stating that it's beyond repair.

Front end damage is evaluated at $4,000.00

Rear end damage evaluated at $7,000.00

Airbags, as mentioned, $3000.
Plus the frame itself is wisted, sop the total repair/rebuild estimate on my dad's car was $16K +

Your front looks a lot worse, so it's definitely more than 4K + 3K or airbags... insurance is not going to fix it. If I were you, I would try to find every receipt I can for all the mods and then demand restitution. If you can't find receipts, and parts are still salvageable, see if the offer you to buy it back after the pay for it.

P.S
I'm in Illinois too, and all of my evaluations were done by reputable shops.

yeah, I'm pretty sure you're screwed. You'll be lucky if you get compensation, and if you do, expect to work for it (lawsuit?)

First of all sorry for your lost. I would call and file a claim under her insurance. If worse comes to worse i would hire a lawyer but then again that might not be cheap.

Sorry to hear what happened. But why were you driving a car without insurance? In NJ it's a crime and mandatory 6-month license suspension if you are caught driving without insurance. I dont know if its mandatory in IL. Good luck
