if it's upside down...does it effect the performance of the sway bar?

I don't know if it'd really hurt it, but it certainly couldn't be beneficial. The bar is curved that way for a reason. Also......I could see it easily binding on the endlink the way his is installed.
Very simple fix though. Just flip it over the other way and you won't have to worry about it hitting the exhaust or not working properly.

none of those including the one you have on the car should rattle once you put the bar on right.

Try using the subframe reinforcement kit. That will stiffin up more, if that's what you wanted. It worked for me. Go on to http://www.A-spec-racing.com Tell Charleston Lou recommended you.
I have the bar with the BSQ kit and my car is even the same color. It doesn't touch my HyTech exhaust which is monstrously huge back there. It comes very close to the bar, but does not touch. I've had a few exhausts on my car with this and not one of them has ever rattled.
Did you put it on right? I'm willing to bet that once you do the bar is nowhere near the exhaust. I'll look for a pic.

which is better? the stock gsr front sway bar and the itr rear sway bar?
Or the Suspension Techniques kit?
ive read about everyone using a beak's or a BSQ Kit for the ITR rear sway bar, is this something you would also need for the ST Kit?
