Patent 4,961,406, which was filed 16 years ago, is the first patent ever issued that changes the size of valve events in relation to engine speed and changes intake valve timing in relation to engine load. It is also the first patent ever issued which uses detonation sensing to control any facet of valve train operation.
I lost this patent due to the failure of the patent’s assignee to pay maintenance fees.
The American auto industry tested and rejected my patents. My ability to raise venture capital to pay the maintenance fees on my 12 patents was terminally compromised by their rejections.
The lone inventor who tries major-league inventions gets picked off because major corporations reject your invention and then use your patent after you lose the patent prematurely for non-payment of maintenance fees. It’s a scam and it should be illegal.
The patent office tells me there is no way to obtain a list of patents reinstated due to unavoidable circumstances. They can’t tell me what the maximum duration of time has been for reinstatement after a patent lapsed for non-payment of maintenance fees.
The patent office notifies the assignee after the patent has lapsed when they can collect the extra fees for reinstatement. They never tell the inventor if the assignee doesn’t pay the maintenance fees. If the business relationship between the assignee and the inventor goes sour the assignee can kill the patent without the inventor being aware the maintenance fees weren’t paid.
I am proposing that patent laws should be changed to provide means for an inventor to reclaim ownership of his invention if the assignee refuses to pay the maintenance fees and the inventor is willing to pay the maintenance fees.
Please contact me if anyone has knowledge of how to obtain information regarding a precedent for reinstatement of a patent due to unavoidable circumstances.</TD></TR></TABLE>
