exactly! sorry it was a long day and i feel asleep and forgot to post up what happened. i was driving down decatur blvd going to the local hardware store to get the stuff so i can make the motor mount i just bought a solid one. well as im in the middle lane this lady pulls out of the post office, on the right side, doing about 2o mph when she merges into my lane with no signal or anything. so i slam on the brakes and slide into her truck. one couple pulls up from behind me, gives me their names and numbers incase i needed a wittness. lady was fairly nice tho. Metro came and sited her for unsafe lane change. her insurance is calling me back today to get the story, goes to their adjuster next wensday to get appraised. just hopin that the check they cut (cause they more than likely arent gunna want to fix it) is enough to go ****** up a jdm front end. and maybe pay a little for paint

that lady is in the wrong the insurance company should be worrying about you sueing them.

take no less then $2000.

at there price you have to get a new carbon fiber hood($400), stock headlights($200 cant replace just one it wont look right), bumper($100) and paint($1,000). and not including the rad support work, alignment and new light bulbs. in the hole atleast $2,000 easily. take em to town boy.

dont forget the upper radiator support and lower turn signals

one of the sad things about most of our cars is that if you get into any accident besides a little fender bender theres a good chance that our cars will have a salvage title ... good luck with getting the money man... dont be like me and just settle for what they want to give you... i was stupid and lost out on $1000 because i didnt have anyone with me at the time who knew what was going on

Good luck getting $2k. I got into an accident and the insurance company said anything over $1300 (mint Si with aftermarket goodies) they would total it. Luckly they denied my claim and I sued the girl and got $1800

Funny part is I had all the replacement parts at my house. (new front and fenders, and corner lenses). Plus they paid me for the c/f hood that I didn't even have on at the time lol. So basically I was only out the scratches on my front rim and my alignment.

unbend and rebuild haha. still going to keep the car but try to get as much as i can out of this unfortunate ordeal. i know i can fix all this on my own time so im hoping i can get enough out of them to ****** up a jdm front and hopefully get the whole car painted. but if not then another stock front end and still get her repainted. too much time and learning experience for me to let it go like that

another insurance company cant total your car and if she has the same insurance company as you they cant total your car they have to fix your car, remember your at no fault. HER policy is paying not yours.

in this case the bookvalue of your car could be $300 it doesnt matter her insurance/agency should pay for your damages even if same company as yours. they just going to have to bend over and bend her over. this is different from getting a car stolen.

if they say we are taking your car to adjuster, you say NO you want someone to come out to look at it instead because you are in no way of getting rid of car unless they have $3-4,000. THAT WAY they dont keep your car and write you a check for $1000 book value and your screwed.

*my story i had a beater 180k on odometer, faded paint, 89 hatch si cai, custom catback, rims, steering wheel, short shifter, shift ****, APC coilovers, headunit. i got in an accident that wasnt my fault. car was totalled couldnt drive it. car was worth around $2100 thats the price of car and mods i added in total. i got a check for $3,000 and book value was $1600. they basically paid for the parts and alittle more to keep me happy and not to sue. i didnt sign anything saying i wouldnt sue and i never threaten them with it i just got a check in the mail.

cliff notes
1 if same insurance company dont worry her policy pays not you
2 make them fix it
3 dont let them total
4 dont settle for less
5 be smart make money money moooney.

Thats not how it works at all. Another insurance company can total your car.

if its still drivable they cant. if its still in your possession they cant. i used to work for Allstate Ins. out of nyc and yes your right they could if you dont know your rights. but this case is special because he has mods and this isnt his fault so therefor the terms are very different. they should kiss this guys *** and keep him calm and pleasant to settle matter easily.

options are this:
1 repair and fix damage fully
2 find him a car, same model and mileage(or close) and let him keep car to switch things over.
3 same as above but dont keep car and write a check to get new parts(which most wont do, unless the parts are damage and cant be swapped like his CF Hood.)
4 you do have a choice to total it if you want if the insurance company ask. (i wouldnt unless its a good price)

This is true too. I wouldn't let them "take" my car for adjustment. I made them come to me. If the insurance doesn't pay up just threaten to sue.

yeh i'm not trying to be fraudulent. but if you choose to total and get parts paid for

i would swap and switch everything out that profitable after adjuster says the ok. they dont know the different in a B or D. because all they are going to do is mail you a check or have you come in a local office and sign for check, and ask whens a good time for Joe Blow with a tow truck can come by and send to junkyard. and not even think of whats on there either way they are at a lost and dont intend to make money off it maybe $300. but be smart replace everything you take atleast leave it moveable. haha

most of the time they dont even go by the price of parts, they go by the total and then work around it and basically they are paying you hush money because you may choose not to spend the money on new parts.

well im not going to let them take the car unless that check is going to be large enough. lol.

the ladies insurance company should be calling me in about 10-20 mins. they setup an appointment for me to go see a claims rep here in town next week so they can get an estimate of the damage. they didnt even offer to take the car. i am however, going to get them to fix the damage. like you said, im the victim here.
