Ok so I just got a ticket for weaving through railroad track arms that were down, BUT there was NO TRAIN COMING.

This is at 6:30AM on a Tuesday morning.

I pull up to the railroad tracks and the arms are down and the lights are flashing like a train is going to come. Some cars are even already lined up waiting, I waited there for a few minutes. I said screw this I have a motorcycle, I can just weave through the arms.

So I pull up to the arms and look both ways, no train, I weave through, and then a LA County Sheriff pulls me right over. (I did not see him on the otherside of the tracks).

I got a infraction ticket for 22451(b) "RR crossing, driver or pedestrian proceeding through a closed crossing gate."

I'm gonna do a Trial by Declaration and see if I can win this. I beat a prior ticket for speeding in a car with a LA County Sheriff. If he writes a letter back, then I will go to court with a lawyer because I already have 2 points on my record.

Oh yeah, this is not the first time these railroad arms have been down. A month ago, a railroad worker held the arms up and let cars through even though no train was coming.

Was I wrong and unsafe in crossing? </TD></TR></TABLE>

Honestly, if the arms were down and there was no train, I don't see the problem. It used to happen a lot in my grandparents home town when I was growing up as there was a lot of tracks there. If it was a malfunction, you just drove through.

Jesus when did this place becoem OSHA?

if it was a semi known problem that the arms malfucntioned from time to time, i'd run it, granted i waited, checked both ways, and proceeded with extreme caution.

those malfunctions happen a lot where I live. I've even seen cops weave through the tracks also!

^ but then again, when do cops even obey the law? i always see them running stop signs, running stop lights, speeding. and this happens way to often for it to always be an emergency and if it were they would have there lights on anyways. ghey

but ya, no diff then a red light. if theres no cars coming, then i would just go.

Sorry Jasper....but I don't follow your reasoning on this one.

If there is no train coming, and they have malfunctioned before, whats the problem?

I don't know if I'd have the ***** to do it, but that doesn't make it something that I would rip someone else apart about.

So whats your reasoning behind giving this guy "the 2005 darwin" award?

I'd do the same thing this kid did. I would do it in my car as well.

No Train = Go

This guy doesn't really deserve a darwin award. However, if he tried crossing it, layed his bike down, then a train came and hit his bike then he would deserve the reward.
