Well yday i was just cruising on a 3 lane road and i'm just driving.. theres a accord that pulled up next to me and said nice car... i say thanx and jsut keep driving... i made a pass and just drove normal... then all of a sudden, i see a cop like 8 cars back in the middle lane(i'm on far left).. he drives then moves one lane to the right.. then 2 minutes later he cuts 3 lanes over and pulls me over and says i'm doing 52 on a 35.. i'm like what da hell? i'm going with the flow of traffic.. i wasen't like moving faster then the other cars.. i was just pacing with them.. can they clock me like that guys? i feel i was treated unfairly cause of the car i have. I have a fullbodykit and gtr wing etc etc.. all the stuff

 

well he could clock u when he pulled behind u but not when he was way back behind u, and the other thing did he show u the radar?? Cuz if he didnt thats the law and u can try and fight it in court....

 

i'm not sure if thats the law in maryland but i just felt like i was harassed, i'm going to court for it. Lawyer or am I wasting my money?

 

When you drive a flashy car you get attention, both wanted and unwanted. Everyone was speeding, but you were in the passing lane driving an attention grabbing car, so you're the one that got the ticket.

Driving with the flow of traffic, etc doesn't matter. You were speeding and he decided to give you a ticket.

 

well its also teh end of the month.. i think he was trying ot meet his quota... we werent all speeding
we were all going bout the same speed like 10 cars on the road .. we all cant be speeding

 

haha... it doesn't [edit]matter[/edit] how many cars are doing it, 50 in a 35 is speeding. Why wouldn't it be?? If 100,000 people are at a concert smoking weed is that suddenly legal too?

Whatever you do, don't try the "everyone else was doing it" arguement on a judge.

If your whole pack of cars was doing 52 in a 35, he has the right to give every single one of you tickets. If there were 10 po-po's around, they could've just pulled over the whole lot of you. Yes, I've seen that happen going down the grapevine into the Los Angeles area. And yes, he did single you out, probably because you were in the left lane and had the flashiest car.

 

The answer IMO is that you'd be wasting alot of money hiring an attorney. (At least in California) you'd lose. The cop will just say you were speeding, and there was no other reason you were pulled over. The only way you'd win is if the cop didn't show up at trial. In CA, the best bet is to enroll in traffic school, waste a Saturday at class, and not get any points on your record. That's if you haven't gone to traffic school in I believe 18 mos. It is probably different where you are. But try traffic school if you can, to save on future insurance premiums. Good luck!

I got attention in my old car w/ its rims, stickers, exhaust, etc etc., which is why I plan on keeping my car as low-key as possible. Right now it looks bone stock except for lowered.

 

a) you were, in fact, speeding
b) the speed of traffic around you is irrelevant if you were, in fact, speeding
c) you *probably* were singled out because of the way your car looks
d) 99% chance that nothing will change in court (although you can always get the charge lowered)

I would just do the typical deal...delay the court date a couple times, and hope the officer doesnt show.

 

Well cops dont need radar to clock you. All they have to do is be behind you going the same speed as you for a certain amount of time. The fact that you were in an Integra didnt help. if you were going 52 mph in a 35 then thats speeding no matter how many people are going the same speed. Like the time I got pulled over on the freeway going with the flow of traffic. speed limit was 65 everyone was going 80. Of course since I'm in a Red Teg I get pulled over.

If I were you I would just go to court and fight it. Say you were safley moving with the flow of traffic. More then likely the judge will reduce your fine or even drop it if the cop does not show. The worst outcome of this would be you will have to pay the fine and go to traffic school.

 

YOu guys dont seem to understand there is no quota....

howeever... in order for him to justify his salary he has to generate paperwork, which means giving tickets... depending on how much of a raise he wants or a promotion depends on how many tickets he gives out....

There is one Riply's believe it or not COP who gives out a ticket ever 5-10 minutes... and has been doing it for a long time... he just tickets you for everything.. speeding, bumper height etc.... I dont remember how many a year he gives out but iti's a lot.!!!!

it means, if everyone is going 10mph, you have to go 10mph (in rain for eg.).

it does not mean if everyone is going 50 in a 30 that you have the right to go that fast, because everyone else was, and you are simply, going with the flow.

cops will profile a car, it is part of what they do, they are trained to do it. he figured, you were a punk kid, chances of something else being wrong with your car were higher (tags expired, etc) than with a fine upstanding citizen that isn't a kid.

just bog down the court system and ask for a trial by jury, if you are going to fight it.

 

ok ok guys.. i didn't clarify this sorry.. i wasen't doing 52... i was going bout 40-45.. which is still high.. but he kinda MADE up that 52.. i wasen't even feeding the car gas.. it was a nice day and i was just cruising to my destination point... but yea.. he wrote the WRONG date on my ticket hahah.. i just foudn that out.. he wrote 03/26/02... u think i can just say he wasen't thinkin right that day?

yea so that's as close as you can get to the definition of a quota.... he slacked off earlier in the month, so the end of the month is coming to a close, reports coming out, even though theres not 'quota' he still looks like crap if he didnt give out no tix....

The cop has to clock you. You should of asked to see the radar. If he did not clock you you can fight it in court. The law states that he cant pull you over unless he has clocked you. In some states like Kansas they have to clock you twice. I dont know if they have to clock you once or twice here in MD, I just moved here.

 

Hmm i go to court TOMORROW for a speeding ticket, i don't think he had me clocked, i didn't ask. I think we was back in traffic and caught up. But all i need to do is get the ticket lowered to 20 over instead of 25.

 

That wrong date nonsense isn't going to get you anywhere.

One of my tickets had:
1. Wrong date (wrong year)
2. Wrong license plate number
3. Wrong driver's license number

I figured, there's no way they even know who I was....so I didn't pay. A few weeks later, I get a letter in the mail saying I didn't pay. WTF!?!? How did they know?

Crazy stuff. You can't escape!

 

the date is wrong thing is what i'm going to use in court because I can say that he cant' even write a date right, how can he say he I was really going 52. But anyways.. i drove by the same road today and turns out.. its a 40mph road.. i'm going to check again tomorrow.. i think he wrote the wrong speed limit.. so i really was only 12 over. 2 wrongs dont make a right
