mod. muffler ticket

well, i got this one day before i left to go to burning man in the nevada desert. (didn't take the r to black rock) , now i'm back dealing with the hurricane and the 40k people that my 150k town took in in louisiana. the cop followed me and gave me a ticket for a modified muffler. he didnt do a sound check or emissions, he just said it was modified and its illegal to have that. so the burden of proof is on me. does anyone know what i should do, i bought the car with the apex n1 exhaust on it, and i dont have a receipt. it's an 01 type r nhbp 57k miles. im thinking that this week the cops are so swamped with other bigger **** that they wont want to deal with this ticket. i'm just confused and pissed to say the least. advice? and hurricane update, every local gun store in my town is sold out of handguns and shotguns, and cops are everywhere. it's pretty crazy.
First off be careful down there. Glad to hear your ok. Next I don't know your rules there but here they would have to do a sound test. It has to be louder than a certain DB. I would either put a stock on it and pay the $5 fine or go down to the PD and have them test for the DB level of it. Good luck down there. I hope everything works out for you.
You'll need to check your local laws. I've gotten 5 illegal exhaust tickets in the last year and a half (skunk2) and they've all been written up under section 375 and it basically says that if you've modified the stock exhaust system in any way, including replacing parts, it is illegal.
I've gotten one thrown out because of no supporting deposition, 2 signed off at the police station by mickey-mousing the stock one on with tape and driving to the station to get it signed off, and then paid for 2 (county issued tickets arent "fixable" ). It should cost you $70 dollars tops if you plead guilty.

if you had the silencer in then just print out the page from the apexi web site with the letter from the chp stating that exhaust modifications are not illegal unless the db is louder than 95db. apexi claims that they do not produce an exhaust louder than 95db(which i'm sure that has to include the silencer since my gt spec is way louder than 95 in vtaak). maybe that will help you in court? good luck.
i'll save you the trouble

I had mine teasted at a referee station and mine came in at 94.9db I have the form that they gave me that I can scan later for you. like everyone said, you have to look into what your local laws are.

my local laws are that if you modify the exhaust in anyway other than stock it's illegal. either for performance or sound, etc. so naturally we got corvettes and tahoes running around going unchecked with flowmasters, but a 4cyl honda will always get the ticket. i'm trying to find a stock exhaust asap. i swear, they let everyone get these exhausts and they pass legislation after everyone bought one so they can make more money off of it. i think i'll just plead guilty and pay the fine and get a stock exhaust.

Thats not always true. As stated before, you need to check locals laws. Some states and counties have laws prohibiting any modifications to the exhaust. Pennsylvania is actually trying to pass such a law (HB-1330). Also, there can be more restrictive local ordinances. While my exhaust is currently legal in PA, I have been ticketed before for violations of a local sound ordinance.

Do the research or pay the fine. If your exhaust is too loud and you know it, suck it up and pay, if you think its legal then go about finding a way out of it.
do the necessary research and take care of it, but be sure to write a letter to a local legislator telling him/her that anyone condoning this inane law is losing your vote. get sympathizers to sign it, or to submit their own. if it's below what's determined to be an illegally offensive dB level and does not endanger anyone above the "dangers" posed by a stocker, it should be none of the state's damned business what you have on your car.
the problem is that too often we suck it up and let this **** slide. we put these assclowns in office, and pay cops to dick us around with this **** instead of doing something more important. the guy that wrote you that citation should be ashamed for so doing, but instead we empower guys like him, who bully us over petty bs at their (in)discretion. he just got paid (with some of your $) to rob you. do what you can to stop him.

I have yet to hear a musclecar with flowmasters or any other modified exhaust sound like ****. On the other hand 90% of every import on the road sounds like ****. I'd give them a ticket too. I like to hear a big block chevelle pull up next to me and shake the crap out of my car, or a mustang for that matter. Old cars sound good with exhaust, most imports dont......

Anyone's subjective opinion doesn't eliminate the double standard. It's just another form of discrimination. Hold everyone to the same standard, or eliminate the law for being ineffective.

I totally agree, but if you heard something completely annoying everyday that you could fix, would you? Not saying that its fair just the way the world turns. I love imports and have an exhaust but mine is nowhere near loud and annoying as some of these things I've heard. If people where doing it all for performance then it wouldnt make a difference but some people just want there car as loud as they can get it.
I deal with annoying situations everyday that could easily be dealt with by double standardization. I deal with stupid people everyday that make annoying decisions that could easily be dealt with by double standardization, but it's not fair to do so. Again, it's a subjective opinion and what one person sees as hellishly annoying, another sees as cool.
Tell the judge, your exhaust is a FACTORY REPLACEMENT or "OE" exhaust that is made SPECIFICALLY for YOUR MODEL.
Then, break out the analogy...
"This is no different than going down to the local Meineke and asking for a new exhaust made to fit my vehicle"

i got a court extension til nov. 28. they are telling me now that i can go get the car sound checked and if i can bring proof that it passes the noise level test, i can keep it as is. the prob is, that the exhaust is loud and will prob not pass the test, also, i dont know any places around here that test for sound, so i now have to search for one. anyone have any experience with the apex n1 silencer? does it screw in, weld in? will it make a noticeable difference in sound? im gonna go search now for n1 silencer topics.

add a second one if you already have one. It should cut down on the noise.

Here in Cali. whenever they gave me a ticket for my loud exhaust, I'd go down to the local CHP or PD and have them check the sound level. I always passed but cops are always giving me tickets for it so I just fight it and have it written off. But now I've changed to a Ws2 and no tickets so far.. Every place is different but check your local PD and tell them you want to fix your exhaust ticket. G-luck
