Default Problem with Brake Lights

Well I have a wierd problem. I have searchd and havent seen anything that would answer my question. One day after the movies I was walking to my car and realised that the rear lights were on. I got in the car thinking I left my lights on, but I did not. When I pressed the brake pedal, the rear lights stayed on.
Not sure what to think? When I disconnect the battery the lights do turn off.

summary : brake lights stay on even when the lights are not on.

what could be causing this problem. A bad fuse would lead to no lights at all? could it be the sensor/switch behind the brake pedal that has gone bad?
