Default Pulled over, is this legal?

Thursday night in Yonkers, NY is a time when alot of import enthusiast show off their rides, burnouts, high rev's and a little red assin'. No big deal to me but I was on my way to work tonite and a cop pulls me over. He goes through the whole thing, DL, reg. insurance and I'm all good.

Now here's where it gets interesting. I asked the officer why he stopped me since he didn't say. His response was that there is problem with reckless drivers, specifically on thurs. nights and they stop alot of vehicles that fit the profile in an effort to suppress the problem. I guess that sounds logical to me.

I asked the officer what profile did I fit into since my DX would prolly win the Nobel prize for a perfect specimen of crap. He said well, we look for cars that have loud exhaust, BOV's, etc. None of which my car has. I asked him how long he intended to delay me getting to work? he said as long as it takes to make him satisfied that I was not part of THEIR problem.

At this point I began to get angry cause I'm about forty minutes late to work and told him that the engine is originall and well over 300K miles and racing would'nt be practical and that if he used a little common sense he would realize that MY car does'nt fit the profile he explained to me previously. He did not respond to my statement and returned to his cruiser and I waited another 15 min. Keep in mind he already ran my plate and I.D. for warants and such!

He returns to my window and now with his partener on the passenger side starts acting as if I'm suspected of something else or he was being a TOOL becuase of my common sense comment earlier. He then asked me to step out of my vehicle and open the hood and I reluctantly agreed.

He takes a look and asked me if I had any after market parts installed in the vehicle? I said yes. Stuff like alt, brake shoes/pads etc. and that this is gettin' ridiculous and I'm very late to work! He then asked me why I seemed to be in a hurry to get outta' here, are you hiding something?

At this point I lost it and told him to **** off! and I hope you get shot off duty so his fat whife and ugly children would live out the rest of there lives on food stamps and public assistance. This proved to be a mistake! He asked me if he could search my car and I told him I'm no longer gonna' cooperate with you, you ******' ****.

Any way I was 2.5 hrs. late to work, does anyone think I have legal complaint against this *****? I fully intend to file a complaint with the department, but I really love to ruin this guys career! Any suggestions?

sorry for the novel but it was necessary to explain my position.

Yes it is worth reading. He was stating that people did that NOT him.

I would think there is a very good case for harassment as there was no real reason for him to pull you over i.e. loud exhaust, speeding, or any traffic violation. They were just looking to pin something on your it seems. Compalin turn this power abusing a-hole cop in.

does your car have a fart can exhaust on it? any cosmetic mods. wing tail lights ect. but i would definately file a complaint. he spends way too much time picking on you while the local homie sells crack to a 15 year old.

There is no law that says that you can not call a cop anything you want. You can't do anything like spit on him/her but you can call them a dog ****** and there is no recourse. It will **** them off and make them look even harder for something to give you a ticket for but there is legally nothing they can do if all you do is use words. At least that is how it is here.

I still think you have a very good complaint. He did not say anything that would be considered harassment but his actions such as keeping you from work for so long with NOTHING close to a good reason would def. be grounds for a complaint.

No, my car doesn't have anything other than a half decent stereo. Yeah, when your not doin' anything wrong and it seems like your being harrassed, then you get a call fromthe local F.O.P. for a donation, it makes me wonder why, If this is the type of people you'll be helping. I'll keep givin' though! even though the F.O.P. sticker didn't score any help with this instance.

Please accept my apologies also. As you read I'm not brightest guy in the world-big mouth.

No tickets or infractions, not even a warning! got his name and badge#. I'm gonna go down to the station tomorrow and see if I can get a minute with his supervisor. I work for the city in rail transit with a city I.D. an f.O.P sticker and two brothers that are state troopers, wtf a little courtesy would be appreciated.

I have nothing against good cops there are a lot of them out there and they have my respect but cops like the one that pulled you over are nothing more than a worthless a-hole.

Hey ive been out there a time or two and it can get pretty wild out there between the races and drunk driving. Im sorry you got pulled over and your innocent but it could have been worse. I got 5 tickets one night at jones beach and a ride home in my buddies car cause mine was taken, just for being at the wrong place at the wrong time. Right now you gotta charge this incident to the game and let it blow over in the wind. Now that thats over who's going to the meet spot tomorrow. I wanna try my new injectors out.

WOW my 65' Malibu was impounded from Jones beach, but I completly deserved that. Did a 8500 rpm hole shot with open cut-outs behind the front wheels. Jones beach, Hunts point, Central ave- Look for the Shark skin grey Malibu tubbed with the bug catcher on the hood. holler at me. BTW I don't race anymore only at E-town, Atco, Maple grove. Street racing is irresponsible

aww atco and etown are the ****.
well i think the cop was a ***. and he didnt tell you why he pulled you over. and on top of that he didnt give you anything. Why pull someone over if they didnt do anything. if he wanted to check out your car it should of took him 20-30mins all together to run stuff and do what he had to like a normal cop. i guess he didnt like you off the back . stick with your normal story .. AHAH you got my dying on your aftermarket goodies lol (brake shoes) ahah wtf who says that. Nice good luck yo

For you yelling at him :

Nothing bad can come of this. 1st amendment stuff. I deal with my neighbor and cops literally every other day because of him being an ******* and yelling **** to everyone, mostly me, for no good reason. Cops wont do ****, they cant.

As for you wanting to complain :

Complain, a report will be made and most likely end up getting lost in our fucked up system somewhere.

Cop was probably bored. I had Elk Grove police pull me over and i was in sacramento. He said my exhaust on my STOCK CX was too loud. I have a magnaflow muffler, and its super quiet. He looked under my hood for about 5 minutes trying to find a turbo or something. then he just told me that he could write me up for my muffler and make me go to the smog ref. and replace anything "illegal" that i had. He didnt ask for DL or ne thing, i was just being harrassed. I get it all the time, Strawbeery red/gold pearl paint, gold rims, big tach, cops say they become "suspicous" of a car like mine. **** that, dick heads.

Good luck on your complaint.

BTW: I was on the freeway obeying all the laws because the cop followed for a good 20 miles.

there a supreme court case, uhh i forget the name but it is about how you can say whatever you want to anyone as long as there isnt a direct threat with intent. i was doing the whole criminal justice thing in NY, but not NYC. in the regular state of ny it is illegal to pull over a car without suspicion and illegal to search a car without probable cause and a warrant. but NYC has its own set of rules... cops down there can pretty much do whatever they want because it is a higher crime area, they get more power to 'fight' more crime. anyway that cop was a ***** and give good cops bad names, you can complain but honestly it prolly will be a bigger waste of your time. good luck though

shitty cops get a

well police are there for a reason. he didn't have any reason for keeping you that long. but once you gave the cop hell, and talked all that ish to him, gave him all the reason to be a jack *** back to you. i know a lot of cops, and they are pretty cool guys, and end up getting crap back just for being cops. a lot of young people don't respect them for what they are really here to do. if your car got stolen, who do you expect to help you? cops right. well yeah, so dont go giving them crap for doing their job. you went a little too far by saying you hope he gets shot, and all that other crap. karma's a B. I. just watch, one day you need a cop, they won't be there for you.
