I just was involved in a bad accident. I was waiting to turn left at a stop light off an off ramp to go to work. Light changes, somebody runs the red light almost completely. I lay on my horn (Hella triple air horns btw), and wait a couple seconds, then proceed to go.

As I'm turning the wheel, I look to my left to see a Dodge RAM pickup plow into me. He hit the front driver's side of the car, spinning me a full 360 degrees to smash into a curb. Both airbags went off. I didn't really believe what just happened.

Anway, I got out to see that my front end is completely gone. Went up to the old geeser in the truck who claimed to not know what just happened. He ran the red light at least 5 seconds into it.

Anyway, I called the cops (one of them was a total dick), got their badge #s, they towed my car. I removed what I could (greddy gauges, boost controller, cd's), but there are a lot of expensive parts still left on the car.

How does this all work out? Should I call my insurance company or call a private lawyer?

I went to the medical center to get checked out, and I don't have any broken bones, just a sprained ankle and neck pain.

The car was a 2000 with 16,000 miles on it, and I put about $9500 in aftermarket parts into it. The insurance company doesn't know about the aftermarket parts, but I can probably find most of the receipts for the stuff I bought, and I have pictures too.

Please help me out here...I've never been through something like this before.

by the way, I have AAA insurance. He has insurance with a smaller company.

wow man i am really sorry. dealing with insurance sucks. did u get all of his insurance info? start with his company. get on the phone with them and start tracking their progress. give them the info they need to process they claim. sounds like he's at fault big time.

He is at fault big time. The bastard is keeping his mouth shut and pretending to not know what happened.

I don't have any witnesses (even though I remember other cars being there). A highway patrol was the first on the scene..and he looked at the way my car was hit and the skid marks to determine that he was at fault. I got his name and badge # and he told me he'd testify if he had to.

I think i'm gonna call a local lawyer and have a consultation tomorrow morning. I just want to make sure I get all the money back out that I put into that car, and sue the ***** for injuries if possible.

call a lawyer and see what they say.... i know they get a 1/3 of what you recover... your entitled to money for pain and suffereing.... give them a call and see what they say....

i ended up using larry h. parker and suiting myown insurance company (allstate) and now they wont insure me.... haha...

anything that is bolted down shoud be covered,besides your not filing thru your own insurance cause this was not your fault. so the old guys insurance HAS to pay for your car and mods,you can use the injuries as a trump card if they refuse to pay for your mods. trust me theyll pay if ou hint that you "might" need to see a doctor and lawyer just to "protect" yourself

on a side note,get the car back and take out any **** that is good, you can make a killing selling the seats,brakes,ecu, etc...

damn that **** sucks.

yeah see a lawyer. they ll have you see one of their doctors and in the end what ever you get total will be split three ways(doc, lawyer, you). but looks like ur share of the money should be 5g's+.

Get a lawyer. They may take a percentage of the money, but it's worth it...IMO. Best wishes to you and hope you feel better.

Well, it sounds like it is almost time to look into buying a used NSX. They go for ~ $35,000 for 91-93 models. Get a Basch supercharger (~6K) and you'll out handle and out run anything on the road. Good Luck!

The law in Texas is that you have two years to sue from the date of the accident, so don't freak out and go running out there looking for any ol' bloodsucker to take your case. Remember, you can get a bad lawyer just like you can get a bad mechanic or a bad doctor. Take your time and find someone whith good qualifications. Very often the best lawyers are known through word of mouth and not TV avertisemsnets (or phone books for that matter).
Many times before a lawyer can even begin to work on your case he'll need more information like the extent of your injuries, and what it's going to take to get you back on your feet. Many times, they don't even start on a case until the client has had some time to recover physically.

So, I guess my point is, to take your time, get better, and then worry about the lawsuit second.

Depend on the type of insurance in your state. If your state does not have no-fault insurance, his insurance should cover it. Your insurance should force his company to pay. Thats how it is supposed to work. The reality is you have to start kicking you insurance company in the butt to their job.

No fault insurance is even more of a scam,,,,,,,, your insrance company pays out to you then his insurance company pays out to your insurance company.

If you cannot get any satisfaction then see a lwayer. Talk to an accident lawyer (ambulance chasers are slimey bastards,, watch him) and make sure you have a case.

And if you feel at all sore or injured see a doctor ASAP!!!!!! Get medical documentation that you are injured. Physical therapy really helps relieve the soreness etc.

In hindsight, the guy driving was definitely speeding, and he didn't even attempt to slow down. When I saw him coming toward me, I didn't see him try to stop at all...no screeching brakes or anything.
He didn't even know what he did until after he collided into me.

And just to think - He was never tested for drunk driving or being under the influence of something. If I were the one who had collided into him, I have a feeling that I would have been fully tested for every possible drug known to man. The guy was either really dumb, or he was under the influence of something, because he seemed very incoherent during the whole ordeal. He asked me who my insurance company was 4 seperate times, and asked me if I thought that my car would have to be towed away. "Is it still driveable, do ya think?"......

What a despicable creature of human life.

Sounds like maybe he fell asleep at the wheel, possibly from being drunk or under the influence of something. I can't believe the cops did not test him for anything. I would bring that up during the trial if there is one.

At least talk to a lawyer to see what your options are. With you being injured, and with your car having many mods this is not just a simple clear cut case.

good to hear you ok man, sorry about the crash. check this. my brother had his 88crx-si with only 22,000miles on it hit by a guy who ran a red light. they covered all his speakers and rims, springs and other things. there never looked to see if the car had that stuff they just took his word for it. however they only gave him book value for his car and we all know that a 88crx-si with only 22,000 miles on it is woth a tons, this car was mint and hardly ever driven. jsut figured i would share his experiance. oh our insurance was farm bur... and it was in south carolina

i think you just lived thru every FI member's worst nightmare: someone wrecking your car right after the major power upgrade. I'm glad to hear you ok and definitely consult a lawyer. the old guy playin dumb is full of ****...good thing is that the police report is in your favor best of luck with everything.

I know how this goes, I was in my brothers car and hit by a drunk driver going 60 in an F150, i was the passenger of this http://www.accordclub.com/wreck/

What you do is go get the full police report and read it. The officer has notes in there that shows who is at fault. If it basically says "yep, the Ram did it" then get the rams insurance info, if you dont have it already, then it SHOULD be on the police report. After that, you call his insurance company and tell them one of thier clients hit you. If they ask you you were hurt, tell them the truth. The insurance company will then either look into it, or if they know already, they will replace everything from the turbo to the car. If you really wanted more money, you could probably could really easily get a settlement from them. If it was cited that it was his fault as well, dont call your insurance company unless the Ram's insurance company starts talking **** on how they arent going to pay ****. But if it was written on the report that it was the Rams fault, they arent going to **** with it and they should just pay you for everything w/o a problem.

thats a good idea ryan i had a simlar suition here in miami a truck ran the redlight hit me on the drivers side and knocked me out cold, when i woke up in the hospital the psa, (public service aid) gave me the ticket she says i was racing just because she saw what i had under the hood. but witnesses said that i was just cusing when the truck took the red.

call EVERYONE...and do it now dude!! Lawyer, insurance..etc.. the insurance company will help you get more money for your car from the other guy's insurance company....go to the hosital and get a check up too...this will also be paid by their insurance...do whatever it takes to get yourself anothe car...

by the way...this will all only work if he is at fault. If he is, its like winning the lottery dude....'casue at the end of the day, you'll probably get a new car out of it...good luck!
