How can I get my money back???
What should I do???? I recently purchased a '98 GSR Head from operatic (https://honda-tech.com/zerothread?id=1070152). I was really glad to find a vtec head that was in my price range and the best part, it arrived the next day!!! BUT, when I received the head, the head was damaged. I don't know if it was damaged from before or from the shipping so I gave him the benefit of the doubt.
I have called operatic and told him the situation and he tells me his brother was the one who shipped it and he was too cheap to insure the package
. I'm like wtf, I am not taking a head that is missing pieces, bent bolts bc he left the bolts attacked to both the intake and exhaust part of the head, broken vtec solenoid, chipped head, etc.
At first he was cool about it and says just ship it back and then Ill refund your paypal account but here's the catch... He wants me to pay for the SHIPPING back to him even though he's the one who didn't package it correctly and did not insure it. So, am I resposible to paying for his mistakes????? And he wants me to ship the head back first before I get my refund.
Is there anyway to get my money back asap? I paid through pp with my CC bc I had a feeling I might get ripped off. What should I do now?? I would like to hear what HT members have to say.

I would first find out what really is going on, sounds like it was broken before shipping.
Was the shipping box damaged or intact? If it was undamaged then he must have known it was damaged before hand.
Also talk to pay pal resoultion center, They're pretty good about people like this.
Either tell them you want a refund or some money back to cover the cost of getting a new vtec solenoid, or something as least. Good luck

One yes, you did get a head sent NEXT DAY by me and it was packaged correctly. It was in one box that contained bubble wrap as well as more cloth to protect the head, hence I have yet to see pictures of what was sent to you. If you want a refund I am not in the business of ******* people. So send me my head back, the very same head, not one that you may have that is trashed and I will refund your money. Also I did let him know that UPS does insure up to 100.00 dollars and from the parts that you told me that needed to be replaced it comes to a today of 80-90.000 Parts from a Honda dealer, not online here on anywhere else, feel free to contact Honda of Hyannis at 508-778-7878. One Day has passed and I have not seen pictures, the shop that I had the head sent to does not seem to answer the phone. There number is 302-798-7000. Is this a shop or one of your buds? Also please state the missing pieces that I said were included that were not there. In any of the conversations we had.
Also including the shipping that was on the 420 tab. Which for your information, shipping on a 72lb head cost me a cool $232.22 for next day before noon.

This is kinda interesting for a guy living in Cali in the first place, having me ship the head to Delaware. So I assume that the head is at a shop. So now you're trying to explain to me that $15 worth of head studs, $10 worth of sand paper and a can of spray paint (to smooth the valve cover and paint it a fresh new coat) and a $70 solenoid is enough to be worth returning?
First off, let's look at the facts. It's already at a shop of some sort and it's across the country. So the information you're working with is based off pictures (of which I've yet to see the pictures of the head now in Delware) and second hand info. Second, you're obviously gonna have some sort of work done to the head and the shop will have to ship it to you anyways. I can tell you right now, ground shipping is gonna be an easy $50. Plus it's at a machine shop, they'll package the thing right so there are no problems with it in the first place. And if it comes arrives messed up, you can take it up with both UPS and the machine shop because they're supposed to know better and be experienced in shipping heavy packages.
Third, it's an aluminum head. It can always be fixed. You can throw that bitch down the street and it can be fixed. Hell, my brother got a set of heads for his car and a piston pushed one of the combustion chambers up screwing the whole thing up. He got it fixed for $300, sent it off to be ported and it's been running fine for the last 2 years. If the shop you have it at can't fix the minor problems you listed, then I'm sorry sir, they're idiots.

Look, I thanked u for shipping it one day. I never asked for it and I was acutally expecting ground. Another thing, I told i'm out of town on VACATION (it is the holidays) so I can't be there to receive the package therefore I had u ship it to the shop where my car was at. I have shipped a lot of stuff with UPS and FEDEX and I have always insured the valve of the product (It does not cost that much extra). Because I am not there to receive the package, the shop explained to me that the head was messed up and that it was NOT a stock gsr head like I assumed I was suppose to be receiving. I'm not saying it's your fault but you should of insure the head making it your responsiblity to do so.

I already asked the shop to provide pic and I told you I would get pix to u when I receive them. I cant get any pix if I'm all the way across the US. I dont have the time and patient to go and fix a head like u suggusted. That is why I asked u for my money back and u can take it to who ever u want to repair the damage. I told u in our PMs that I would send the pix before I ship it back. I explained to u that I will NOT pay for the shippiing cost of a head I did not damage. Supposely the head was damage by UPS but bc u did not insure it UPS will not cover more than 100 dollars (which is free 100 for every shipment by UPS) for the damage. I dont have the time to wait for repairs when I have my car stuck in the stop already for 2 weeks without a head.

I will once i get it but that's not the pt. The damage is there no matter if the heead already had damage before or it was caused by shipping. He didn't pay for insurance so now I'm out of a head and the full value of the head.
The pt is why do I want to keep something that is banged up when I can get a perfect one for the same price??? And why should I pay for the shipping cost back to him when it's not my fault?

Ya, funny.. if u didnt know. I insure the freaking package and it's not my fault fedex didn't want to pay. I packaged it just fine and the shipping company tore up the box and damage the fenders. In this case, this seller NEVER insured the package and there is no way I can any money back from UPS.
The head is repairable, and the seller says he is willing to pay the damage so we'll see if he comes through

why should you get any money then? you didn't give me any money, due to your insufficient packaging. you even said in my thread that you didn't have enough money to buy sufficient packaging materials. your case is the same. you say that the shipping company messed up your package and now you want the seller to help you out. YOU, didn't help me out when this happened to ME. SO I HAVE NO SIMPATHY WHATSOEVER FOR YOU. laters.

yes I didnt have enough, but i did wrapped the bubble wrap on the edges not the whole fenders. I insured your package.. I did everything u ask, I faxed fedex and asked the refund for you.. The seller didnt even insure it so I cant ask UPS to fix this problem..
If the seller had insure the package, I would ask UPS and if I didnt get anything that would be the END.

And after your incident, I have made sure to have either UPS or FEDEX wrap my packages if the product is too big to insure the safety of the items. I have sold a lot of stuff on HT and you were the only problem I had.
that is basic **** that can be fixed easily. you got the head for a good price so pay a few bucks to have the little **** welded, go to a junk yard n get the sensor, and just cut the cam gear cover all the way off! thats no reason for u to send it back.
also if the seller says it wasnt like that when he shipped it the broken pieces of the valve cover should be in the box. take a pic of that too so he knows you didnt swap em

Like I mention before, the head is repairable and I have no time to get a perfect head. The damage to the head cost around 200 dollars (with parts) so it's not cheap.
