Default need some advice....

ok, here is the deal.... i sold this c/f hood that i had to some guy. i got the money order from the guy and shipped the hood to him like 3 months ago. i tried to e-mail him after i shipped it to confirm that he got it. none of the e-mails went through ( i guess his mail-box was full or something). well, he didn't cantact me for 3 months so i'm thinking he got it. but he e-mails me today saying he never got it and that he's gonna call his lawyer if i don't send him the hood or the money. what the hell am i supposed to do???? i sent the hood a long time ago. the thing is, i don't have the receipt from the post office any more, i can't find it. i mean, its been 3 months. i don't keep frickin receipts for that long...
now, i think he got it, but he's gonna try to get his money back too. which is really f'd up because i honestly sent the hood. what can he actually do? can he make me pay him just because i don't have that receipt any more????

Thats why you get delivery confirmation and insurance Other then that I dont know what to tell you to do

Three months??? Sounds like this guy is trying to pull something. I'd see if you can get some kind of delivery confirmation just like everyone else said. Three months is too long to wait and notify the shipper that the merchandise hasn't arrived. I don't buy it.

Yeah I have to agree here, I mean seriously who waits 3 months before getting all pissed off about not recieving something they bought on the internet, I am sure we have all ordered one part or another over the internet, man personally if it goes three days after I have paid and no word from the seller I start dropping a lot of emails, no one waits 3 months, he is bluffing let him call his bluff, email him back and say this

"I am sorry you feel you never recieved the hood, but it has been three months and I have tried to contact you, and you never responded. The hood was sent if you still believe I didn't send it then we can settle this in court, I have the shipping documents" Now I know you don't have the shipping documents but he doesn't, just tell him you have them and if he wants you guys can take it to court, I promise you if you email him just what I said you wont' hear from him again, going to court over a few hundred dollars isn't worth it, and he knows it, he is just trying to scare you into sending him his money back, don't buy into it.

he e-mailed me again today, saying that its going to be easy for him to beat me in court because i have no proof that i sent the hood (i don't have the receipt any more). so i e-mailed him back saying that i got three witnesses instead (my friend whose van we used to take the to post office and two more guys).
i also told him how he should have said something earlier instead of jumping on my back 3 months later... he replied he was in "boot camp" and that's why he never got back to me. well, the fact of the matter is that he waited three months, and i don't really give a rats @$$ where he was. he wasn't in prison. honestly does any of you guys keep receipts for that long???? i will from now on just because of this crap, but c'mon now... what do you all think judge is going to say, IF he takes me to court? i hate ppl like that, aren't there honest ways to make money any more???? i really don't know what to do with this guy.
and i don't want to give him $400 just like that.
sorry for whining but i am getting a big headache from this issue.

sorry to hear about all of this man, i hate it when people try to pull **** over on you...good luck, but i doubt hes willing to take you to court over this ****...and cmon....3 months in bootcamp?

He's lying, or else the damn thing got ripped off his porch when it was delivered or something. Dont worry about it, I doubt he'll have the ***** to go to court anyway.

boot camp is only about 6 weeks, if in marines i think its 8 weeks... but 3 months (12 weeks)?? i don't think anyone would want to be in boot camp for that long!! i don't trust that buyer... besides, after the first few weeks of boot camp you can contact the "outside world", it's not like your stuck in some box! LOL

Marine bootcamp is 13 weeks long... just went through it myself this summer. It is a possibility that he went there but why would you buy a CF hood RIGHT before you leave for bootcamp??? I call BSBSBSBSBS!!

ummmm....im SURE he signed for it, since the post office doesnt drop of boxes of that size just like that. tell him you have the receipt and that YOUR lawyer is already aware of the situation and is preparing all the paperwork for harassment.

i suggest you check with the shipping company to see if they can audit their records. maybe you will come up with a tracking #.

I agree with Bishop; I keep them that long and I would explain your situation to whoever shipped it for you and see if they can get you a proof of delivery.

I would try getting a tracking # from the post office, if they ask for the reciept, ask them if they can track it with your name or phone #. If that doesn't work, then good luck.

Try contacting the post office/UPS/whoever you used to ship it. If you got a
receipt from them, they'll have it on their records, and will prob'ly be able to
provide you with a copy. I, myself, know how long it (usaually) takes for "specialty"
parts to ship, so I usually don't bitch, even for months, but taking months to
whine about a "user-to-user" sale, (where the merchandise is ready to go), does
sound "fishy". I'd say he didn't like it/didn't meet his expectations, and wanted his money back, but knew/knows the sale was on an AS-IS basis. **** him!
People like that should fry in hell. Just get that copy and say: BRING IT! the next
time he mentions "legal action".

hey if this fool tries to take you to court its only going to be accepted in a small claims court.so you figure him trying to argue his case, not only do you have 3 witnesses but he left him residemts while the package should have arrived which is neglagence on his part. so al in all you may win some money from him for " emotional damages". so **** this rat he aint gonna keep up his part of the argument.his name wasnt steve mcclanhan (or something) was it?
thats the guy who is king of numerous scandal that i have made a victim of..

thanx for all the advice guys, i feel a little better about this now.
i e-mailed this guy back two days ago and told him to call his lawyer if he thinks i'm trying to rip him off. he hasn't responded since.
his name wasn't steve mcclanhan by the way.

Yea...Who on earth would order a hood when they go to basic...plus...if he was in basic...then its no wonder he didn't get the hood...they dont even let you receive cookies...I couldnt imagine the DI allowing you to put a hood under your bunk!
