what do you mean "touching" is it actually grabbing and the brakes are giving resistance to the car/wheels? or do you just mean that the clearance between the pads/rotors/caliper are very near the rotor/appear to be very close/touching the pads?
its not like a mountain bike/bike where when you release the brake lever the brake pads spread a lot apart from the rim.... if thats what your thinking it should be.. not sure if I'm understanding your question correctly.. is it actually grabbing/applying the brake when the e-brake is off?
put your car in gear, put wheel chocks on the front tires.. jack your car up and support it on jack stands.. and release the e-brake.. now spin the rear tires by hand and see if they spin freely w/ the E-brake down.. if they spin freely your OK.. there isn't much visual clearance between the pads and rotor..

thanks for the info i will have to try this out.
The pads just looked like they were touching. Im not sure if they are grabbing or not. thanks for the detailed response
