Default My baby has been hit!!!

I was heading to my Dad's place, top down, and enjoying the beautiful December weather. I love South Texas winters. Must of been low 70s, not a cloud in the sky. I'm on a two lane road, two way traffic.

I'm rounding a corner and a 98 sentra gxe pulls out. I'm going 36 mph. The posted limit is 30 and I know instantly there isn't enough time or distance or maneuvering space. We're going to collide. Them bam, metal on metal shearing. Fortunately it was a low speed impact and no one was injured, however my car got F$@! My passenger front fender hits her driver's side. My car appears the worse for it. The front passenger tire is hanging by the LCA and shock mount. The UCA is no longer attached. The entire front passenger panel is totaled. In fact a hole was ripped into it, however it didn't appear to enter the engine cabin or get to the passenger door. The frame rails appeared untouched too. It's an 02 and most likely won't be totaled. Damn.

This is where it get funny. I'm a pretty chill guy. I ask if she's okay. She is. Said her kids are okay too. Cool. Her cell is out and I lend her mine. Everyone and their dog show up from her family. No biggie. Still taking calls on my cell. Still no biggie. The women appeared to be shaken up a bit. The men from her family are wondering if I was speeding?!? WTF. Did you talk to your girl?? But no worries I humor their questions. All she says is she saw me come round the corner.

If I were speeding, I would of left some sort of skid pattern (even with abs). I left no rubber on the road. Lets say I had no time to hit the brakes (since I was speeding), then a 35+ mph collision should of deployed my air bag. No airbags deployed on either vehicle.

Police show up to take statements and such and she lies about who's in the car. What?!? The cop suggests their car go to a collision shop so as to avoid having to pay another wrecker to take it to a collision shop. They don't want to do that. They want to take it home. He spends a good 10 minutes persuading them otherwise and they relent.

Spoke with her insurance agent and she says the only hiccup I could have is if she disputes her pulling out. Considering I was on the main road, I don't see how she could dispute pulling out in front of me. Agent said she can't try to argue I was speeding. Her only recourse is the pulling out alibi. How can that work? I just blatantly rammed into her? I wasn't paying attention when she entered my lane? In any of those scenarios isn't it her responsibility to judge her distance to safely enter? Oh yeah, hours later, her agent said her client had not been returning her calls. I hope they're not trying to get their "story" straight.

You were traveling down the road and had the right of way. She entered the roadway without yielding the right of way to you. If you rear-ended her, it would be your fault, but she didn't get onto the road completely, which implies she didn't complete her maneuver and did not have the right of way.

She would have been ticketed as being "at-fault" no matter what she said or comes up with. The physical evidence points to her failure to yield, period. There is no case.

i agree... although even if she was hit behind she could have been totally at fault, just depends on the scenario...

It really depends on how good of a liar she is and if she can cry on demand.

dude blow....last year i bought an RSX-S and one month later i totaled it : (

and insurance was a biotch, took 9 months to get my money from the totaled car

so i fell your pain....hope all goes well wit u my son
