Bought an S2K, but it has issues. What would you do??

Bought an S2K, but it has issues. What would you do??
Bought a 2002 S2K Saturday evening. Has 39k on it, so its right out of any factory warrenty. Test dorve great considering the wet weather. Got out Sunday to drive it around and show all the friends. I noticed that after it was driven for about 30 minutes, 2nd gear would sometimes grind. I then noticed that 3rd gear was hard to get into, no grinding, but it felt like it was trying to kick the shifter back. All this along with a viberation comeing from the rear of the car at a hard acceleration.
Took it back to the dealer Monday.Of course they freaked, get me into a loaner car, and said they would take car of it (along with the HOLE in the top the car wash person put into it right before I took delivery), but if they couldnt, they would get me into something else.
I'm just not to happy about getting the car back with all the issues I have had with it in less than 24 hrs. Would I be in the right to just return the car, or am I stuck with it?? Had the car in my possesion for about 36 hours before it back to the dealer.
If I was able to return the car, I would find another S2k. I loved it while it lasted!!!

i am not sure if you can return it. if i could, i would. i am very **** about small things and it would bother me to know it was broken when i bought it. you know?

that my thought too. Its one thing for me to break it, and its another to have bought it broken and not know it.
By law, you have 48 hours to renig on the deal. They will fight it, but its the law (good friend works at a different used car dealer and shared this info with me). I know I am technically past that point, but I feel with the cost involved on there part, it maybe cheaper for them to just drop the deal and run the car through auction.
I have been thinking hard on this being as I really liked the car, but I know I can get another. Guess I'll be talking to the dealer to see.

Honda has that new policy, they practically throw the keys to the building at you...Im sure you will be able to get it all fixed with a new tranny. If not get a lawyer. Lawyers can get you what you want

I don't know how I'd feel about it, probably I would want a different one. If the gearbox is grinding, that means the previous owner ripped in it and didn't care.

why do you say your car is out of warrenty
i thought all hondas and acuras came with 4 year 40,000 mile warrentys
if you only have 39,000 on yours your still under warrenty
tell them you want a whole new trans, and a whole new top, or else your going to return the entire car

Just got home from the dealer. Car was bought from a Toyota/Mercedes dealership. There not Honda. They did ship the car out to a sister Honda dealership of theres and the news was not good.
First, the car came with a 3year/36k warranty, so thats out the window. They were hoping they were going to cover it in "Good Faith" but they wont.
On top of the problems listed in my first post, the dealer that has the car now has informed us that the diff is bad too. So, new top, new trans, and new diff. The dealer I bought the car from said they would make things right, OR they will just reverse the whole deal and get me out of the car (they perfered to do that). We both agreed and the paper work gets cancelled out tomorrow.
I dont want a beat on car, nor does the dealership. Hell, they even said they were scared of the car being as the problems it has now and the problems that are sure to pop up.
Going to Dallas weekend after next to see about another. Easter weekend, car dealers, and banks DONT mix

It sounds like you are getting this resolved but Id thought Id mention that here in NY a 90 day 4000 mile warranty is required by law for cars bought from used car lots. Texas is different Im sure but you could check your state laws for lemon laws and such.

Why would you want to return it? You would've had a new drivetrain and a new soft top. These problems are problems a lot of S 2000's have. It doesn't mean the car was "beat on". I would've kept it and made them fix that stuff. They're going to have to do it anyway and someone else is going to end up with a new top and a new drivetrain. And what's the guarantee that your next S 2000 won't have the same issues say 30 days after you purchase it? Then you're SOL.
