CA Bill to Protect Hobbyists From Unfair Exhaust Noise Citations Becomes Law

Governor Gray Davis signed into law SEMA-sponsored legislation to compel law enforcement to tie exhaust system noise citations to a 95-decibel limit under SAE test procedure J1169. The bill was initiated to address the problem of motorists who drive vehicles legally equipped with modified exhaust systems from being erroneously cited for exceeding noise limits and to remove all conflicting provisions in the law and regulations. The bill still allows officers to cite based on a subjective determination that the exhaust system exceeds the 95-decibel limit. This provision remains a bone of contention and SEMA continues to work with the California Highway Patrol and others to investigate possible solutions.

You guys would love South Carolina.......you don't even need a license plate. I've seen people with no exhaust and no license plate. It's crazy!!!!!!!!!!!! There isn't a State inspection, so if your car runs......it's legal.

Here is the only item that I don't like:

The bill still allows officers to cite based on a subjective determination that the exhaust system exceeds the 95-decibel limit.
Yoshi - do you know when this law goes into effect? Does it supercede local noise ordenances?

if this is the sb1081 there is loopholes like i said explained they can still pull you over check out streetracing.org for sgt grants response to it in the vehicle codes n forum.......

will spoon n1 work as well? i heard its louder then apexi n1? i didnt put on yet.. but it did arrive to my friends pad yesterday.. damn it looks so fresh and so clean
I plan on having that with a straight pipe as well.. i wonder if it will be louder then my sebring on my EG with no cat.
Also can you get a ticket or even get in more serious chit by driving around with a front plate from another country here in CA??

i would hazzard a guess that an n1-type exaust w/o silencer and w/o cat may be over 95db.
you're just waving a red flag with a foreign front plate as i've been pulled over for no front plate and nothing else.

So now instead of "defective exhaust", you'll find yourself being pulled over because you "fit the description." The government will just find yet another illegitimate excuse to detain you.

just becareful of the smog check points. I've seen several of these and it's not a pretty site. Also, getting caught for no cat is a pretty hefty fine

Where exactly have you seen these smog check points? I have heard of them, but never have come across any. What type of roads do they hold them on? What do they look like? Are there "escape" roads you could take once you spot them, just like the sobriety check points? Thank you for any info you could share.

they really don't like when you attempt to flip a bitch and escape. sometimes they position hidden cars to snag dodgers and best believe you'll be getting the full body cavity search. i've never run into a smog check point but they are as real as diarrhea.

not only have I seen these checkpoints, I have also seen the "hidden" ones. These use an infrared laser to measure your tailpipe emissions. If the computer calculates that you're putting out t00 much, then a camera takes pix of your license plate. The DMV sends you a letter telling you to go to a smog ref to get measured. These "hidden" ones were on Wilsure Blvd the freeway onramp and the other one was right on the small street of UCI where everyone passes thru. These may have been test sniffers, but it's really obvious b/c you'll see two tripods on each side of the road holding the laser and sensor. From these, you can see cable leading to a plain looking white van w/ a camera hidden behind the slightly tinted window.

As for the checkpoints, I've seen these in Santa Ana, Torrance, & Carson. All three streets were the kind where there was no possible escape. The only way to avoid it was to make an illegal U-turn right in the middle of the street. It's actually kinda funny to see b/c they use dynojets so it looks like people are getting HP dyno runs on the side of the road in their h00pty mobiles

Also, for all you street racers. CHP & local law enforcement take w/ them a CARB official during huge street racing busts. CARB officials inspect each car and point out any illegal items on the car, ie. test pipes, turbo kits, hybrid motors, etc.

So basically, if you have anything questionable on your car, just hope you don't get caught in one of these things.

So what this is say is the cops can only write the ticket if they <U>subjectively</U> fell it viloates SAE test procedure J1169? If they are going to let the cops enforce a scientific test procedure should they use it too? I will need to get a copy of this procedure and run it myself.

Like anything else the cops can <U>subjectively</U> write a ticket for anything they want. My friend got a wreckless driving a 7-11 parking lot. He was parking. 2 mph! Figure that one out.

We have those "hidden" exhaust check points here in AZ also.....If I'm running a test pipe at the time I see one I clutch, shut the car off, and just coast through it no problem...after I pass it I restart my car and I'm on my way... I usually run a carsound cat though.

If you are ever on the 101 look for the white vans sitting at the exits....I travel the 101 every day and see them probably twice a week. Where are you in Scottsdale? I'm at 94th st and thunderbird.....We need to get a local meet going.

Here in Colorado we are getting ready to make the switch to roadside testing. You will no longer have to get smaogged on a regular basis. Instead they'll just have the laser machines at different points and if your car throws a warning they'll take a picture of your plate and send you a summons for smog testing.

I kind of like that idea.

He was in Los Gatos, and chirped the tires while cresting the drive way. It was in a slammed Capri with loud exhaust. The cop stated in court he was doing 30 mph when he entered the parking lot (very small BTW) and made and imediate right to the parking space and came to a complete halt stop. All with about 15 ft! Damn that thing is like the Batmobile.
