Goodbye stolen TYPE R....Hello 2004 Suzuka S2000....oh no, BAD ACCIDENT!!
There are a LOT of misc. body panels that make up that rear end, along with things like the subframe, suspension parts, possibly the gas tank. Whether or not it will be totalled depends on the value that the adjuster comes up with. Good luck on that.
I've heard stories of the rear end breaking lose, but it's usually around a corner. Cold tires, road ice, quirky diff with cold fluid.. any combination could have done it. Did it break lose upon an upshift?

part of your problem right there....
the rest is still up in the air... you stated it was below 32.. so your tires aren't up to optimal usage... so doing an upshift at the wrong time/place could of caused your tires to spin..... (this has happend to be)... i'd end up doing an upshift while i'm going over a bump (that i didn't realize was there) and my tires would spin and the tail end would slide out a little.....
it sucks for you.. but you damaged the worst part of the car.. and the most expensive area to fix...

so....a wreck going at about 30-40 miles (spinning must have scrubbed off some speed) would cause that much damage??? looks a little much

Bah! Give me a good ol' 300+hp straight 6 to stuff into my S, and I'll be happy. All them sissies can learn to drive at a school or the track/auto-x.

shouda not tapped the brake. just steer in the direction you wanted to go. but damm good luck with the insurance. thats odd how out of no where it just spins out. there must have been ice on the road or sumthin. or like oil in a part of the road where u lost traction...
Damn bad luck dude, dig that s2k.
Do not use any type of "performance" tyre when it gets as cold as down to 0 degrees Celsius. The tyre compound becomes hard like a Hockey puck and the grip is prettymuch useless. Even standard compound tires suck at these temperatures.
So be extra careful when the temperatures drop below 5 degrees celsius with performance tires. For an example at 3 C i spin my Azenis in second gear just by flooring it when moving with my stock D16z6...
Winter tyres should be considered even if it doesn't snow that often but get's below 5C now and then at the winter. The compound in winter tyres differ ALOT from standard tyres, and do not get any allseason bullshit tires. As they suck both summer and wintertime.
/Per from Sweden where winter tyres are required by Law Between 1 Dec and 1 April if the temperature is below freezing.
And the wintertyres could be used as poormans drag radials, racing summertime :D

it looks totalled to me mainly because of the extent of the rear damage. i have seen s2k's totalled for less. time to start talking to your insurance adjuster again. if it was on loan, i hope you bought gap insurance

cancel that warranty asap, if its within a certain amount of days, you can get a full refund

that is crazy. Is it common for s2k's to lose control that easily? My back end swung out a day or two ago after easily gassing it through a turn on my way to work. Scared the **** out of me!
