Default CRVtec ECU Vtec problems

I just blew and rebuilt a B20B hooked up to an old school B16A1 head run by a p28>Skunk2 harness. on OBDII wires. I have been breaking in the bearings after taking over .2 and finally I am able to open it up, but when I hit Vtec the first time after it starts my check engine light comes on. More often than not it is off the next time the engine is started until I hit Vtec again. I have not been going to my old shop because they left and axle out and f--- up some other stuff on the rebuild, but my new shop is not performance driven. They say there Snap-on ecu diagnostic can't communicate with the ECU, the first time it was because they used the OBDII socket. Anyways they repaired some stuff, same problem. They then spent 6 hours doing wire searching and troubleshooting and nothing. They didn't charge me, but I am not sure what the hell is wrong. Any ideas?

If it is the Vtec that is tripping the CEL what should I have my shop check to trouble shoot it? I am buying a new ECU w/ Hondata, for the hell of it, but to see if it is an ECU problem.
