MR2 Got Damaged...... any advice?
I just got back from the scene. My brother called me up and told me his MR2 was backed into. The guy put his car in neutral and accidently went into reverse. He told my brother he thought he was in neutral. My brother told me the other driver backed into him and basically was sitting on top of his car. The guy kept apologizing and when the cops came he decided to make up another story and told them that my brother rear ended him. What does my brother do now? How is insurance gonna handle this? BTW, this was a SUV.

Here is what it looks like now. If you look carefully, if my brother rear ended him I wouldnt think the damage would look anything near what you see in the pics. I'm sure it would have done alot more damage. The guys freakin tow hooks cause the hood to get cut open.

No witnesses. I even went inside the nissan dealership to ask if anyone had seen what happened but nobody saw. I only saw the aftermath. My brother is flippin out right now cuz he only has liability.
insurance people can tell whos fault it was from the damage no?

yeah man.. im pretty sure that a insurance company can tell the difference.. but the question is how the other guys insurance is going to judge it.. i would say its pretty obvious that he backed over the MR2 ... but good luck.. im sure it will work out fine.. and keep us updated

Nah, I wasnt there. I only got there to take pics. My brother babies that car. I highly doubt he would lie to me and my parents about this. Parents were there cuz he didnt know what to do but we both dont live with my parents and we both work hard to modify our cars.
oem peices are quite expensive...i guess you can upgrade as a fix...
new bumper (aftermarket like TOMS), carbon hood, and clear headlight covers with projector lights...
its a fix and it'll look bas@ss...

why do you have to prove who did it when the guy admitted to it

He admitted to it before the cops came, when the cops came he changed his story and is now lying about the situation.

all it takes is a good insurance claims adjuster to look at the vehicle and see what caused the damage.. obviously they can tell how the damage was caused... witnesses or not.. these guys see enough crashed where they can tell the difference between backing into someone or rearending someone..
kind of a hard case if you really look at it. how can you tell a difference from a car moving back or you moving forward? Same damage. But it looks like a low speed accident, how can someone go slow and not notice the car in front of them like that. People say take him to court? With only money to pay for liability how is he gonna get money to pay a lawyer? cost more then the repair. Either way, good luck from it all, happened kinda similar to me so i feel for you guys man. peace
Yeah. They will know because it would have been smashed if he rear ended the guy. Your bro would have had to drive slowly under the SUV to cause that damage. It's obvious no one would actually do that and proves the SUV guy is not telling the truth.
Damn.. that car looked clean too. I say play the guilt trip. Call the guy up and say "I hope you're happy, I spent every penny I had on this car and now it's all gone to waste because you're lying, I'm going to have to part it out blah blah blah". If the guy has a half a conscience he will fess up.
edit: also if he does fess up and you get insurance $$ I would do what someone else already posted... get a bomex/toms front, tom sides, jdm clear corners.. mr2 parts are very expensive and it will probably be cheaper to do, not to mention 10 times better looking

i just don't see that happening. at this point he's already filed a false police report, and already proven himself to be an asswipe. he'd never put his *** on the line for a clean conscience.
