Default Another 1st for Virginia

I buddy of mine got pulled last night in NOVA for "non-factory or factory approved exhaust". I had never heard of this one. It was like a $60 ticket. Is there anyway to fight this or is this actually the law and he just has to live with it. It is a Greddy Evo exhaust.

go home, take it off, put on the stock exhaust, go back to the police station/court and show them you "fixed" it. go home, take off the stock exhaust, put back on the aftermarket exhaust. welcome to the world of aftermarket exhausts.

va law basically says if its not oem its illegal, so basically everyone that goes too mineke is breaking the law, however it's only enforced on imports. put stock back on, get your case dismissed, then put your exhaust back on.

The VA law says something to the effect that it has to be "of the factory type", or as DragII put it ... if it's not OEM it's probably illegal.

Not much you can do about it, unless you want to go in and argue that it IS of the factopry type, and see what THEY have to say in response to clarify the matter. At least there aren't any driving points attached to this violation.

I tried fighting my ticket in VA. The cop said, "they probably told you this exhaust is carb exempt and legal in all 50 states. Well it's not!"

I swapped the stock exhaust back on, Went to court and the judge said that if it wasn't OE, it's not legal. I paid my fine, court costs, spent WAY too much time at the government center, blew vacation time, and ended up saing ~$5.

Just pay it in advance and chalk it up to cost of ownership. Man this is bringing me down......

VA sucks.......i repeat VA sucks. Had i not been from PA and on my way to visit my sick gf my car would have been impounded according to the Trooper who pulled me over. I hate that state with a passion......for reasons i didnt state here obviously. Those who know me better understand my hostility .

Yeah, no real point in fighting it in VA, it's not really a fix-it. Either way, you'll pay the 50 dollar court fee no matter what, then 20-30 dollars for the fine. You're better off just paying the extra 20-30 and not inconveniencing your entire day.

The NC troopers I have dealt with were very courteous. Still got a ticket, but at least they were nice about it

I have had a Thermal on my car for 60k miles in NOVA, been pulled over 4 times (2 for speeding, two for no front plate) and not one cop mentioned my exhaust at all. I think some people are on the gas WAY too much when they shouldn't be.

Even super loud N1's and such can be driven rather quietly when needed.

OK pull up a chair.

Superstreet Tour 2002 for NOPI y0, Im crusing in a pack of about 300 cars through Carabbus(sp?) county, Im actually the last car in the pack. Not speeding, a lot of traffic, just cruising. NC Trooper coming the other way on the highway, turns around through the grassy median, to pull me over for "following too closely". I was driving my friends civic at the time, the R was out of commission which I will get to in a sec.

I tried to explain to him I was with a TOUR and the point of a TOUR was to stay together. It wasnt like I was tail gating some old lady who didnt want me behind her. As soon as I opened my mouth, he flips out in the typical southern redneck voice "I DUNT GEEVE A FUUHHHK!!" and tells me to get outta the car. I had to sit in the front of his cruiser for 10min while he ran all my info an wrote me a ticket, and talked to me in an overly nice way just to annoy me even more. It really was your typical nothing-better-to-do ticket for an out of state driver

To add insult to this ****, I later promptly paid my fine that was CLEARLY written on the ticket, and promptly received my fine back, saying it was insufficient and the fines were changed recently and the hillbilly officer overlooked it. So I had to pay $25 more than originally thought. I thought to myself, OK these ******* are only doing this because Im out of state, and because I didnt want to drive there to fight it, I punked out and paid the extra $25.

I then receive a letter back saying that now my payment was LATE because I didnt pay by the original fine date on the ticket. Now they are totally abusing their power. Needless to say, I did not pay that ****. A few weeks later, I get pulled over in the R in NY, just after getting it put back together because the interior was stolen, totalled, etc, and it had been off the road a year and a half. It was literally my first day driving it, and I was going to get gas for it so I could have it dynoed the following day. The car wasnt even registered or inspected yet, and of course I got pulled over. Sure enough my license came back as suspended and I had no clue about it. I get arrested, and my friend has to drive the car back to my house. A few days later I then got a notice from NYS DMV saying my license was suspended for failure to pay the NC fine. At this point, Im ready to kill everyone. I called the NC DMV, raised ******* hell, got them to send me a receipt stating that I DID pay the fine so I could get my NY license reinstated, and explain to the judge and my insurance that it should not have been suspended in the first place. Holy pain in the *** all because of that dumbass cop who had nothing better to do than bust the ***** of an out of state driver. There is a little more to the outcome of this story, but I gotta keep that confidential

Can you see why Im bitter towards NC and their police and "justice" system?

Ahh yet another reason why I think VA is the biggest shithole "commonwealth" (aka, VA is so shitty it has to consider itself special, let's not call it a state!! no!!!) in the US.

VA law -
§ 46.2-1047. Muffler cutout, etc., illegal.

It shall be unlawful to sell or offer for sale any (i) muffler without interior baffle plates or other effective muffling device or (ii) gutted muffler, muffler cutout, or straight exhaust. It shall be unlawful for any person to operate on the highways in the Commonwealth a motor vehicle equipped with a gutted muffler, muffler cutout, or straight exhaust.


§ 46.2-1049. Exhaust system in good working order.

No person shall drive and no owner of a motor vehicle shall permit or allow the operation of any vehicle on a highway unless it is equipped with an exhaust system of a type installed as standard factory equipment, or comparable to that designed for use on the particular vehicle as standard factory equipment, in good working order and in constant operation to prevent excessive or unusual noise. An exhaust system shall not be deemed to prevent excessive or unusual noise if it permits the escape of noise in excess of that permitted by the standard factory equipment exhaust system of private passenger motor vehicles or trucks of standard make.

The term "exhaust system," as used in this section, means all the parts of a motor vehicle through which the exhaust passes after leaving the engine block.

Chambered pipes are not an effective muffling device to prevent excessive or unusual noise.

I've had my EH2 for 6 years and received 3 tickets for my exahust over the years. I'd say I'm getting a good deal!

I had just put a Thermal on my car and was driving SLOWLY with my Mom following me back to my house. The Cop cut her off to pull me over. Oh, when we first passed him, he was on the side of the road writing a ticket for a modded civic.

Maybe it's your neck of the woods in VA. FFX county officers are on the lookout for imports. 90% of the cases in court the day I went, were guys with improper lighting, improper noise suppression from exhaust, too low....

Thanks again for all the responses. I called my friend and told him, he might as well just pay the ticket and be over it. He then tells me he got to reading the ticket and his 97 Green Integra is listed as a 2001 Black Honda Accord. So he might get out of this after all.

Funny this happened in Cabarrus County. My only two tickets *ever* were both issued in Cabarrus County, NC. I live about a hundred miles from there

Of course, my brother holds the same opinion of WVa troopers. He got a ticket for 60 in a 55 the day before his wedding up there.

yup yup my friend got his 4 th exhaust ticket..they took his plates away from him and told him to two the car home, and that he had 14 days to change his exhaust or it will be impounded

Thank god I live in hickland South Carolina where we don't even have inspections. I wonder what that law would do for an aftermarket dealer installed exhaust like a TRD exhaust system? The manufacturer considers it OEM. Dunno???

I brought the receipt for the job the shop did and showed it to the judge. Apparently, it's illegal in VA for a shop to put on anything that isn't up to par with VA state law, so that pretty much sealed my case. I went on further to show him pictures of the exhaust itself on the car. I told him it was a matter of opinion, and that the officer did not check the entire exhaust system, and it was based entirely on sight alone, which is unjust because the exhaust is a SYSTEM that works as a whole, and not separate units. (Woot woot, spreading some TI knowledge) and that officer had not investigated this. The judge agreed. He said he had to find me guilty beyond a reasonable doubt--but there is doubt, so case dismissed. So for those out there who are afraid to fight the case--don't be if you know you're right. I honestly think I was just targeted for the way my car is.
