i've wondered this after seeing the hid hi/low-beam retrofit.
but...
the aiming of the hi-beam is too high for a fog usage. fog lights tend to be aimed lower, not out so far.
now, if you can aim the hi-beam low with out affecting the low-beam aim, then you're ok.
just run a new switch to the lights and a lower-rating bulb. you should be ok. also, if it is a yellow-tinted lense or bulb, then you wouldn't be given crap from law enforcement. a driving light can be a white color.
good luck man.

In Florida I don't think it's legal to have auxillary lighting on with the highbeams. I got pulled years ago for having highs and driving lights going at the same time. The cop told me it was supposed to be wired so that when the highbeams are switched on, the driving lights switch off.
