my hatch likes to be a pain too...it won't open when it's unlocked...it's a new problem too...but it's not a biggie...the trick i came across was turning the key clockwise (to open) until it makes a pop/click noise and then i quickly use the lever to open it with the other hand...oh yeah...it's for a 98 ls, but maybe you can use my trick

The toggle switch that releases the latch will tend to stick. You have to move the switch over with your finger to its original position. Otherwise the hatch will not open.

Just a side note...my hatch will not open without the key and that prevented the rest of my stereo from being stolen last weekend. I have the rear hatch cover and a rear strut bar which the theives could not wedge the sub or other equipment between so they left it. Too bad they got away with the amp on the back seat
