Exhaust citiation questions

Default Exhaust citiation questions

Ok, its a long story but I will try to make it short, I got two fix it ticket for my exhaust, the first one is a $10 fee, ok, no problem with it. I took off the aftermarket exhaust and put the OEM back and have the police clear it. THen it come the second one, the bail is $77 because the CHP use a different citiation which basically siad it can't be fixed. Should I go to court and fight for it because I already put the OEM back on it, I rather pay $10 bucks instead of $77. What happen if I lose? Higher bail? What should I say in the court, should I say not guility because the CHP gave a wrong citiation? ANyone has the same expenience?

Explain more in detail on why you recieved the citation. I'll tell you right now, if this is your 2nd citation for the same offense, it wont look good when you see the judge. But first please explain why you were cited.

Well, I have yet to be cited (and I may not be, I have a Mugen exhaust which is quite mellow), but I posed the question about what to do to my sister (who is an attorney) if I were cited (and I also refuse to mount a front licence plate, which is also a fix-it ticket in CA).

Anyway... just pay the fine and consider it a tax. They can't do anything to you other than charge you money. Certainly, in your situation, I'd rather pay the $10 than the $77... but really, it's not too much...

And rememeber not to jump on the gas when there are cops about...

I have had similiar experiences. In one County it was only a $10 fix-it ticket. While in another County, it was a $130 fine only. No need to get it fixed or signed off.

The first time, I just paid the $130. The second time, I got it signed off anyway at the CHP and went to the arraignment to plead "not guilty", but the Judge just saw it was signed off and dismissed the case. No fine at all. I didn't even have to enter any plea or say a word.

The first one I got it on a local road, the police said I have a modfied exhaust which is louder than the OEM, and I explain the manufacturere (Apex-i) said it is 50 states legal, then he said, no matter what the manufacturer said, as long as it is louder than OEM, it is a fix it ticket. So this one is $10 bucks, no problem with it. THe seond one I got it on a freeway, and the CHP on a motorcycle gave me the ticket, at that time, I told him, hey two weeks ago I already got a ticket for a modified exhaust hoping that he will let me go because I already got one ticket for it. But he igonred me and handed me the citiation, at first, I said to myseld, what the heck I will just put on the OEM and apy $20 bucks for two tickets, not too bad. BUt when the second notice came in, it doen't have the $10 option for fixed citiation, it just have $77 on it and I asked the court clerk and she said it cited it is a non-fixable item, so it's $77. IF I don't agree, I can go to court.....
So should I go? Because at first, I feel it is unfair to get two ticket for the same thing. And the second ticket being non-fixable really pisssed me off because it is fixed now and I want to pay $10 bucks and save the $67 bucks........

SEMA just had a big thing about this in one of their newsletters, imports being cited even though they had 50 State legal exhausts. If its CARB certified, then that pig cop is in the wrong. Take pictures of your exhaust, and bring proof showing it is indeed legal. If you show proof, I think all you'll have to pay is like $5 I believe and you're on your way. Just dont go in acting like a badass, tell the judge you own a CARB certified exhaust, here are the pictures and here is the CARB #. Once he sees that you'll be cool.

BTW, as long as it doesnt exceed 95db its cool, unless they've changed it.
